SUMMARY
This contract provides for the replacement of the felled Cary Haas Pedestrian Bridge spanning over San Leandro Creek between Cary Drive and Haas Avenue with a prefabricated steel truss bridge as shown in project plans and specifications of Bid 25-26.013.
RECOMMENDATIONS
Staff recommend the following:
• Award a construction contract in the amount of $976,775 to Con-Quest Contractors, Inc. for the Cary Haas Pedestrian Bridge Replacement, Project No. 2024.1010; and
• Authorize the City Manager or designee to negotiate and approve individual change orders up to 10% (or $97,678) of the original contract amount; and
• Authorize the City Manager to negotiate and approve change orders up to a cumulative value of 30% (or $293,033) of the original contract amount
BACKGROUND
The Cary Haas Pedestrian bridge, formerly known as the Haas Footbridge, was constructed in 1972 over the San Leandro creek connecting Cary Drive and Haas Avenue. It had served as an alternate and pedestrian friendly path of travel for residents or visitors form the residential areas to/from Bancroft Middle School, Memorial Park, San Leandro Main Library, and the many retail businesses along Bancroft Avenue.
In March 2023, a severe storm event occurred which toppled trees onto the bridge. The bridge collapsed, disconnecting the frame from the abutment on the East ( Cary Drive side) and into the San Leandro creek. The removal of the disaster remnants and partial restoration efforts were ultimately completed in September 2024.
In September 2024, the City Council accepted a letter of intent for a $5,000,000 contribution from an anonymous donor towards the design and reconstruction of the Cary-Haas Bridge. Using the partial initial disbursement of the accepted $5,000,000 donation, the City was able to expeditiously proceed with the solicitation of a consultant team to design and produce construction plans for the reinstatement of pedestrian path of a travel.
In October 2024 the City Council awarded a Contractual Services Agreement to MNS Engineers, Inc. for professional design services for the Cary-Haas Pedestrian Bridge Replacement Project.
Analysis
Bids for the construction of the Cary-Haas Pedestrian Bridge Replacement Project were opened on June 24, 2026. The City received seven (7) bids ranging from $976,775 to $2,287,895. The pre-bid engineer’s estimate for the project was $1,072,830. Following a review of the bids, staff determined that Con-Quest Contractors, Inc. (Con-Quest) submitted the lowest responsive bid.
Staff recommend awarding the construction contract to Con-Quest in the amount of $976,775. Staff have verified that Con-Quest holds a valid California Contractors State License Board license of classification ‘A’ and is registered with the California Department of Industrial Relations.
The project is subject to the provisions of the Community Workforce Agreement (CWA). Con-Quest, a San Leandro based business, has agreed to the provisions upon submission of a signed City of San Leandro Community Workforce Agreement to be Bound included in their bid.
Consistent with standard construction industry practices, staff balanced site investigation costs with the risk of encountering unforeseen conditions during construction, as well as the level of design details provided on the plans. As a result, unforeseen conditions may be encountered during construction, and plan details may require adjustments or clarifications. Additionally, because the project spans above San Leandro creek, unintended impacts to the creek could affect both the cost and progress of the work.
To minimize potential project delays and to allow adjustments to the scope of work as needed to deliver a high-quality project for the City, staff request authorization to negotiate and approve change orders up to 10% ($97,678) of the original contract amount and cumulative change orders up to 30% ($293,033) of the original contract amount. This authorization will help efficient project completion.

Previous Actions
• On September 5, 2023, by Resolution 2023-121, the City Council found that emergency conditions existed that do not permit a delay resulting from a competitive solicitation for bids and authorized the City Manager to award an emergency construction contract to McGuire & Hester for the demolition and removal of the Cary-Haas Street Pedestrian Bridge and associated debris in the amount of $227,500, with authority to approve cumulative change orders of up to 10% ($22,750.00) for a total contract amount not to exceed $250,250. The City Council also approved the re-appropriation of $250,250.00 from the FY2022-2023 budget to the FY 2023-2024 budget in Account No. 010-38-903-5240 to fund the emergency project.
• On July 15, 2024, by Resolution 2024-096, the City Council approved and authorized the City Manager to execute Amendment No. 2 in the amount of $15,140 to a consulting services agreement with Terraphase Engineering, Inc. for environmental permitting support for the Cary Haas Pedestrian Bridge Removal Project
• On September 3, 2024, by Resolution 2024-114, the City Council accepted the letter of intent to donate and authorized the City Manager to expend the donated funds in the amount of $5,000,00 to support the replacement of the Cary-Haas Pedestrian Bridge
• On October 21, 2024, by Resolution 2024-131, the City Council approved and authorized the City Manager to execute a contractual services agreement with MNS Engineers, Inc. in the amount of $407,197 for professional design services for the Cary-Haas Pedestrian Bridge Replacement, Project No. 2024.1010. The City Council also authorized the City Manager to negotiate and approve individual contract amendments up to 10% ($40,700) and cumulative contract amendments of up to 25% ($101,800) of the original contract amount.
• On February 3, 2025, by Resolution no. 2025-010, the City Council approved and authorized City Manager to execute Amendment No. 2 to the existing Consultant Services Agreement with Mcguire & Hester For The Demolition And Removal Of The Cary-Haas Avenue Pedestrian Bridge And Other Debris for a new total not-to-exceed amount of $363,768.17
• On September 15, 2025, by Resolution 2025-122, the City Council approved and authorized the City Manager to execute Amendment No. 1 to the existing Consulting Services Agreement with MNS Engineers, Inc. increasing the not-to- exceed amount by $106,140 for a revised total not-to-exceed amount of $513,337; and to authorize additional agreement amendments of up to a maximum of 15% ($77,000) of the revised total contract amount of $513,337 for continued professional design services in support of the project.

Summary of Public Outreach Efforts
The project’s Notice to Bidders, Plans and Specifications were advertised starting June 5th on several publications such as Alameda Publishing Company Corp, World Journal, and posted on the City’s website. Staff also notified builders’ exchanges, construction data firms, and various contractors that requested to be notified of bidding opportunities via email.
Properties adjacent to the work will receive notification prior to the commencement of work by city staff or designated representative.

This Council action will not impact fund balance because sufficient funds have previously been appropriated with the City Council acceptance of a $5,000,000 donation to aid in the replacement of the Cary-Haas Pedestrian Bridge associated with Resolution No. 2024-114.
