SUMMARY

 

Staff recommends that the City Council approve an ordinance amending Chapter 1-3, “Boards and Commissions” of the San Leandro Municipal Code to add the Bicycle and Pedestrian Advisory Commission and Article 18 - Bicycle and Pedestrian Advisory Commission to the San Leandro Municipal Code

 

RECOMMENDATIONS

 

Staff recommends that the City Council approve an ordinance to:

 

a)                     Amend Municipal Code Chapter 1-3 to add the Bicycle and Pedestrian Advisory Commission as a commission;

b)                     Add Article 18 Bicycle and Pedestrian Advisory Commission to San Leandro Municipal Code Chapter 1-3, Boards and Commissions; and

 

BACKGROUND

 

In 2011, the City Council approved Resolution No. 2011-011 permanently establishing the Bicycle and Pedestrian Advisory Commission (BPAC). Section 4 of the resolution authorizes the Director of the Engineering and Transportation Department (re-organized as the Public Works Department) to develop rules and procedures and administer the BPAC.

The ordinance publishes the revised sections of San Leandro Municipal Code Chapter 1-3, as follows:

A Resolution to add Article 28 Bicycle and Pedestrian Advisory Commission to the San Leandro Administrative Code will be presented in the seconding reading of the ordinance for consent scheduled for the City Council Meeting on December 2nd. By resolution, the Council will add Title 28 to the San Leandro Administrative Code as follows:

Approval of the ordinance and resolution will formalize and codify the BPAC’s rules and procedures, its members, and their powers and duties.

                     Recommendation to solicit input from existing BPAC Members regarding staff recommendations and the size of the commission

                     Recommendation to further consider alternate sizes of the commission: twelve (12) members and one (1) Mayor’s at large member; six (6) members and one (1) Mayor’s at larger member; twelve (12) members and three (3) Mayor’s at large members

 

Bicycle and Pedestrian Advisory Commission (September 24, 2024)

                     The current BPAC was briefed regarding the proposed commission size, term limits, powers and duties, and timeline for approval and future appointments. The Commission provided input and feedback regarding scheduling and frequency of meetings in addition to consideration of an overall goal and vision of the BPAC

 

City Council Rules Committee (October 23, 2024)

                     No comments related to amendment and addition. Recommendation of approval to City Council of ordinance scheduled for the November 18th Council meeting

 

 

Legal Analysis

 

The City Attorney reviewed, conducted legal research, drafted, and approved the proposed ordinance and edits to this staff report.

 

 

Financial Impacts

 

There is no new fiscal impact because of this ordinance.
