ADOPT: Resolution Authorizing the City Manager to Execute a Lease Agreement with Family Services Counseling and Community Resource Center for the City Property Located at 2208 San Leandro Boulevard, Contingent upon the Completion of Certain Conditions (extends the lease with the tenant for five years with a five-year option to renew if the tenant completes some maintenance items beforehand)

Recitals
WHEREAS, the City of San Leandro ("City") owns certain real property commonly known as 2208 San Leandro Boulevard, which is a portion of APN 075-0087-015 (the "Property"), upon which a one-story building and an adjacent parking lot are located; and
WHEREAS, in September, 1997, the City entered into a lease agreement (the "Lease") for the building and the adjacent parking (the "Premises") located on the Property with the Family Services Counseling and Community Resource Center ("Family Services"), a nonprofit that assists in the strengthening of family life in the community through professional and affordable counseling; and
WHEREAS, the Lease expires on August 31, 2012; and
WHEREAS, the purposes and work of Family Services are of interest and benefit to, and will promote the general welfare of, the residents of San Leandro; and
WHEREAS, the City desires to lease the Premises once again to Family Services, and Family Services desires to lease from the City the Premises by execution of a new lease agreement substantially in the form attached to this Resolution, and as detailed in the Staff Report accompanying this Resolution (the "Agreement"), contingent upon the covenants contained in the Agreement; and
WHEREAS, the Agreement is contingent upon the completion, by Family Services prior to the Effective Date of the Agreement, of the maintenance tasks listed in Exhibit B of the Agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. The recitals above are hereby true and correct and incorporated herein.
2. That the Agreement between the City of San Leandro and the Family Services Counseling and Community Resource Center is hereby approved contingent upon the completion of the maintenance tasks listed in Exhibit B of the Agreement.
3. That the City Manager is hereby authorized and directed to execute said Agreement, subject to approval of the Agreement as to form by the City Attorney.
