Resolution Approving the Transfer of and Authorizing the City Manager to Execute All Documents Related to a Grant Deed and a Grant of Easement to the Alameda County Flood Control District for the Real Property Commonly Known as 2048 Farallon Drive and 2046 Farallon Drive, APN's 077B-0851-016-07 and 077B-0851-060-00
 
Body
      WHEREAS, the City of San Leandro owns certain real property and rights to an easement situated in the City of San Leandro, California, APNs 077B-0851-016-17 and 077B-0851-050-00 (the "Properties"); and
 
      WHEREAS, the Properties are improved by a storm drain pump station, and an access easement to the storm drain pump station (together, the "Improvements"), all as depicted in the attached Exhibit A.  In 1972, the City and the Alameda County Flood Control District (the "District") agreed that the District would take over the operations of the Improvements, which the District has operated since then; and
 
      WHEREAS, the ownership of the Properties was not transferred, even though the District has operated and managed the Improvements since the District agreed to take on the responsibility; and
 
      WHEREAS, it is the desire of the Parties to execute a transfer of the Properties from the City to the District; and
 
      WHEREAS, in accordance with California Government Code section 65402, and City of San Leandro Administrative Code section 5.7.100, the Planning Commission found that the disposition of the Properties conforms to the City's General Plan.
  
      NOW, THEREFORE, the City of San Leandro, does resolve, declare, determine, and order as follows:
 
      SECTION 1.  The City of San Leandro hereby specifically finds that all of the facts stated above are true and correct.
 
      SECTION 2.  That the City Council of the City of San Leandro approves the transfer of the Properties to the District, and the City Manager is hereby authorized to execute a Grant Deed and a Grant of Easement, substantially in the form attached hereto, to the District for the Properties.
