SUMMARY
The first amendment to the Consulting Services Agreement with Larry Walker Associates, Inc. (LWA”) will enable the City to continue planning for urgent stormwater compliance related program development, implementation, and reporting.
RECOMMENDATIONS
Staff recommend that the City Council approve and authorize the City Manager to execute a first amendment to the Consulting Services Agreement with LWA for Municipal Regional Stormwater Permit (MRP) compliance support for a not-to-exceed amount of $219,500. The proposed amendment will fund LWA’s ongoing services through the next two fiscal years ending on June 30, 2027.
BACKGROUND
As a result of the 1972 Clean Water Act that established the National Pollutant Discharge Elimination System (NPDES), the San Francisco Regional Water Quality Control Board (RWQCB) issues the Municipal Regional Stormwater Permit (MRP), which specifies and mandates stormwater pollution prevention activities. The MRP requires 70+ municipalities in the Bay Area, including the City of San Leandro, to place conditions on development projects to incorporate site design measures, source controls, treatment measures, and on larger projects, flow duration controls (FDCs), and requires the City to inspect, maintain, and install trash control programs and infrastructure.
On September 1, 2024, the City entered into an agreement with LWA for MRP compliance planning support, and as of the end of last fiscal year (the fiscal year ending June 30, 2025), the City has utilized the existing contract’s not-to-exceed amount of $49,000. Additional work was identified to continue stormwater program development and MRP compliance that will cost an additional $170,500.
Analysis
The provisions of the MRP are complex and increasingly progressive with each update to the permit. The current permit is MRP 3. The provisions of the permit are technical and expensive to implement, and LWA assistance will allow for clearer navigation of these requirements.
LWA will assist staff in the planning and implementation of the requirements of MRP 3, including support for the development of the MRP Annual Report.
Legal Analysis
The consultant has agreed to the terms of the contract.
Financial Impacts
The original Agreement with LWA was for $49,000 and was executed September 1, 2024. Sufficient funds are included in the Fiscal Year 2025-2026 Storm Water Fund budget for consulting services in the following amount to fund Amendment No. 1:
• STORM WATER COMPLIANCE ADMINISTRATION, Account 598-58-006-5120: $170,500
The amended Agreement will not impact fund balance because there are funds available in the FY2025-2026 adopted budget.
