Adopt a Resolution to Authorize the City Manager to Execute a Memorandum of Understanding between the City of San Leandro and Oro Loma Sanitary District for Refuse, Green Waste, and Recycling Services in the L3 Area

SUMMARY

 

The City of San Leandro and the Oro Loma Sanitary District have executed a Memorandum of Understanding (MOU) for Refuse, Green Waste, and Recycling Services in the L3 service area. The Oro Loma Sanitary District would like to extend the MOU through the term of their exclusive contract with Waste Management of Alameda County through December 31, 2037. As part of the agreement with the City, the District agrees to comply with the requirements of SB 1383 Short-Lived Climate Pollutant Reduction Strategy in conjunction with the City’s efforts.

 

 RECOMMENDATIONS

 

Staff recommends that the City Council authorize the City Manager to execute a memorandum of understanding with the Oro Loma Sanitary District through December 31, 2037.

 

BACKGROUND

 

In 2006, the City of San Leandro (“City”) and the Oro Loma Sanitary District (“District”) entered into an agreement for refuse, green waste, and recycling services in the L-3 area. The agreement provided for the terms of service and a City-imposed franchise fee for the term of the District’s contract with Waste Management of Alameda County (WMAC), which was originally set to expire on August 31, 2012 with two one-year options to renew.

 

On June 6, 2011, the District provided written notification to the City that they were in discussions with WMAC to renew the prior contract. The District also stated that it would make efforts to incorporate additional services levels into the new contract as part of the discussion. In the MOU, dated December 20, 2011, the City and the District agreed to the following service enhancements:

 

                     Free recycling and organics collection to commercial customers.

                     Free curbside collection of batteries and cell phones.

                     Free recycling services to public schools within the L-3 area.

                     Recycling of materials collected from curbside bulky goods program.

                     WMAC commercial recycling staff (20-hours per week) to conduct outreach in the L-3 area.

                     Residential collection of used automobile filters

                     Up to two (2) 64-gallon recycling carts for bi-weekly collection for residential customers.

 

The District must provide the City with a minimum (1) year notice prior to taking any action to extend any franchise beyond the expiration date. The current franchise and MOU are set to expire on August 31, 2024 unless extended. The District is seeking joint authorization of an MOU with the City prior to approving the extension with Waste Management of Alameda County.

 

Analysis

 

The proposed MOU will extend the contract until December 31, 2037 in conjunction with the extension of the District’s exclusive franchise with Waste Management of Alameda County.

 

In addition to the contract extension, the new agreement includes provisions for:

 

                     Providing community cleanup collections of bagged litter up to five times per week, up to two cubic yards per collection.

                     Providing new labeled refuse, recycling, and green waste carts to all cart customers in the L-3 area at no cost to the customers or to the City.

                     Ensuring compliance with all requirements of State of California Code of Regulations Title 14, Division 7, Chapter 3 or commonly referred to as SB 1383 Short-lived Climate Pollutants (SLCP): Organic Waste Reductions regulations in coordination with the City. 

 

The MOU with the District currently generates, for the City, approximately $900,000 in franchise fee revenues to the General Fund, and approximately $40,000 in Alameda County Measure D grant revenues to the Environmental Services fund annually.

 

Previous Actions

 

Resolution No. 2006-061 authorized a first amended Agreement between the City of San Leandro and the Oro Loma Sanitary District and established a franchise fee on refuse services in the L-3 area.

 

Resolution No. 2011-188 authorized the City Manager to execute a memorandum of understanding with the Oro Loma Sanitary District for Refuse, Green Waste, and Recycling Services in the L3 Area.
