SUMMARY AND RECOMMENDATIONS
Staff recommend that the City Council adopt a resolution to approve and authorize the City Manager to execute Amendment No. 2 to the current agreement with the East Bay SPCA, extending the term for an additional eighteen months and increasing the total not to exceed amount of compensation by $579,500, for a total amount not to exceed $1,517,000. Staff evaluated alternative facilities and determined that they are less efficient and more costly due to services being divided among multiple locations.
BACKGROUND
The Police Department currently relies on the East Bay SPCA to provide quality animal sheltering services as part of its core community service operations. Since 2021, the Police Department has developed a strong working relationship with the SPCA. Prior to 2021, the City contracted with the City of Fremont for animal shelter services; however, the City of Fremont was no longer able to accommodate the volume of services required by San Leandro.
In March 2025, staff began conducting a multi-county survey to evaluate alternative animal sheltering options within Alameda and Contra Costa Counties. Using the most recent service call data as a baseline, staff assessed both service capacity and projected costs for potential providers. The Police Department’s Animal Control Unit contacted the following agencies: Contra Costa County Animal Services, City of Berkeley, City of Hayward, City of Alameda, and Alameda County Animal Services. All agencies, with the exception of the East Bay SPCA, declined due to capacity constraints. The East Bay SPCA utilized the current service delivery data to estimate the cost of continuing to provide comparable services at its facility.
On June 2, 2025, Chief Angela Averiett presented an overview of the cost for a six-month contract (July through December 2025) with East Bay SPCA and advised Council that a contract extension might return for formal consideration. At that time, Council was informed of the expenses associated with the Animal Control contract and notified that a request for additional funding could be forthcoming.
On July 21, 2025, Council approved Amendment No. 1 to the East Bay SPCA agreement, authorizing a six-month extension while alternative animal sheltering options were explored, with the understanding that staff might need to return to Council if no viable alternatives were identified.
Analysis
Continued research through September 2025 confirmed that available alternatives would require splitting services among multiple providers, resulting in higher overall costs and reduced efficiency compared to the current arrangement with the East Bay SPCA. As of September 2025, all viable alternative options were exhausted.
The San Leandro Municipal Code requires the Animal Control Shelter providing contract services to the City to impound and securely hold any animals found running loose, tied, staked, or being herded or pastured in any street or other City-owned or City-controlled area. Individuals who encounter stray animals may bring them to the East Bay SPCA at no charge, provided the animals are at large when delivered to the facility (SLMC 4-11-400; 4-11-405).
The Municipal Code violations place an additional burden on the City by obligating it to absorb the costs associated with the intake and boarding of stray animals. To help minimize these costs, staff limit their response to stray-animal calls unless the animals are vicious or injured. Staff also make efforts to temporarily shelter strays to support reunification with their owners before transporting them to the East Bay SPCA.
If approved by the Council, the second amendment to the agreement with the East Bay SPCA will extend the existing contract for an additional eighteen months.

Financial Impacts
This Council action will be partially funded with salary savings within the Police Department. A total of $181,000 will be reappropriated for Amendment #2 from Account 010-21-005-4101 to Account 010-22-001-5120. Because this contract was not fully funded for Fiscal Year 2026-2027, an additional Council appropriation of $181,000 from the General Fund Undesignated Fund Balance into Account 010-22-001-5120 will be required and will be included for Council review and consideration as part of the FY 2026-2027 mid-cycle budget adjustments.
Additionally, because this expenditure is expected to be ongoing, staff anticipates that an additional annual draw of approximately $181,000 from the General Fund Undesignated Fund Balance will be required if the City continues with the current SPCA contract under the existing terms. Over the ten-year planning period (FY 2027 to 2035), it is estimated that $1.8M in undesignated fund balance would be needed to fully support the SPCA contract.
