SUMMARY AND RECOMMENDATIONS
Staff recommends that the City Council accept the work and authorize the City Manager to file the Notice of Completion, release the performance and payment bonds, and release the maintenance bond upon successful completion of the one-year maintenance period.
BACKGROUND
In partnership with Lit San Leandro and to promote business growth in the local area, high speed communication infrastructure was expanded into underserved industrial areas of the City, primarily the Adams Tract, Catalina/Farallon area, and the southern Alvarado corridor. The City received grant funding from the United States Economic Development Agency (EDA) for the installation of communication conduits.
The project expanded the City’s communications network capability by installing approximately eight and a half miles of conduit ready to receive fiber optic cables. The City’s fiber optic conduit network now exceeds 26 miles (see attached map).
A favorable bidding environment allowed this project to be completed under budget and add additional conduit alignments into the project scope. A contract change order enabled an increase from 7.5 to 8.5 miles of installed conduit and at completion, the project remained under budget. Remaining grant funds will be used in a subsequent project to further increase the fiber optic conduit network.
In addition to promoting growth and creating jobs in the industrial sector, the extensive conduit network infrastructure also provides the opportunity for schools, the community and businesses throughout the city to easily and readily connect to high speed internet communication service. The planning, investment and effort placed in building the network is second to none in similar communities in and beyond the San Francisco Bay Area and provides the potential for citizens, businesses and visitors to thrive in the digital environment and help keep our community on the cusp of innovation.
Analysis
Construction is complete. The work was inspected and deemed to comply with the contract documents and City standards.
Previous Actions
• On July 7, 2014 by Resolution No. 2014-068, the City Council awarded a contract for construction of the work to Flatiron Electric Group, Inc.
• On June 15, 2015 by Resolution No. 2015-107, the City Council increased the construction contract change order cap from 25% to 40%.
Permits and/or Variances Granted
A Caltrans Encroachment permit was issued for the segment of work within the State right of way.
Union Pacific Railroad issued Wireline Crossing Agreements for the locations where the project crossed railroad right of way.
Environmental Review
The project was determined categorically exempt pursuant to subsection 15304(f), ‘Minor Alteration to Land’ of the California Environmental Quality Act (CEQA) guidelines.
Fiscal Impacts
A summary of the construction contract with Flatiron Electric Group, Inc., is below:
Original Contract $1,325,350.00
Change Orders $ 418,798.11
Total Contract Amount $1,744,148.11
The contractor submitted a claim in the amount of $113,000.00 for work they believe is an extra to the contract. The claim will be handled in accordance with the terms of the contract.
The project cost is $2,173,798.00, including design and construction administration (including the full claim allowance of $113,000).
Budget Authority
The total appropriation for the Project is funded from the following sources:
• $2,121,000 EDA Grant funds in account 150-38-347 appropriated as part of the Fiscal Year 2012-13 budget.
• $150,000 Developer Fees for Street Improvements (DFSI) funds in account
120-38-347 appropriated as part of the Fiscal Year 2012-13 budget.
• $352,000 General Funds in account 210-38-347 appropriated as part of the Fiscal Year 2012-13 budget.
