SUMMARY
This contract amendment provides for additional consulting services for various engineering assignments related to the implementation of the City’s Capital Improvement Program.
RECOMMENDATIONS
Staff recommend the following:
• Approve Amendment No. 2 to the Consulting Services Agreement with Activewayz Engineering to increase the Not-to-Exceed amount by $101,500 to a revised Not-to-Exceed amount of $200,000.
BACKGROUND
To supplement City staff capacity, the City periodically retains on-call consultants to assist with the delivery of Capital Improvement Program projects. This approach allows the City to respond quickly to urgent design needs that may otherwise take several months to address.
On April 19, 2024, the City entered into an On-Call Consulting Services Agreement with Activewayz Engineering (Activewayz) with a Not-to-Exceed amount of $98,500. This initial Not-to-Exceed amount was based on the estimated level of effort required to assist staff with the Annual Street Sealing 2024 Project.
In December 2025, pursuant to the terms of the Agreement, the City extended the term of the Agreement with Activewayz for an additional one-year term through December 31, 2026.
Analysis
There continues to be an urgent need to maintain the City’s aging roadway infrastructure. In particular, staff continue to receive several requests from residents to address pavement conditions within their neighborhood.
To address the continued level of infrastructure maintenance needed, staff recommend amending the Consulting Services Agreement with Activewayz to increase the Not-to-Exceed amount by $101,500 to $200,00. This would allow Activewayz to assist staff with the delivery of additional infrastructure improvement projects such as Annual Street Sealing and the evaluation of pavement and roadway profile on Oakes Boulevard.

• On December 24, 2024, the City Manager executed CSA Amendment No.1 to extend the CSA Agreement with Activewayz Engineering to December 31, 2026
Applicable General Plan Policies
• Transportation Goal T-2: Design and operate streets to be safe, attractive, and accessible for all transportation users whether they are pedestrians, bicyclist, transit riders or motorists, regardless of age or ability.
• Transportation Goal T-3: Promote and accommodate alternative, environmentally friendly methods of transportation, such as walking and bicycling.
• Transportation Goal T-5: Improve major transportation arteries for circulation in and around the city.
• Transportation Goal T-7: Improve traffic safety and reduce the potential for accidents on San Leandro streets.
Financial Impacts
There is sufficient budget included in project budgets to account for the increase in the Agreement. This Council action will not impact fund balance, as tasks assigned to the consultant pursuant to the Agreement are charged to projects that have been previously funded.
