SUMMARY & RECOMMENDATION
Staff recommends that the City Council approve and authorize the City Manager to execute the attached resolution that would facilitate a consulting services agreement with an existing vendor (Terraphase Engineering) to conduct a climate vulnerability assessment and flooding plan for the Tony Lema Landfill, in an amount not to exceed $37,920. If adopted, this agreement would enable the City to meet the mandated requirements of the San Francisco Regional Water Quality Control Board that such plans be developed for all landfills throughout the region that are located adjacent to San Francisco Bay.
BACKGROUND
The California Regional Water Quality Control Board for the San Francisco Bay Region has found there are more than 30 landfills located immediately adjacent to San Francisco Bay, including the Tony Lema Landfill in San Leandro. These Bayfront landfills are inherently vulnerable to sea level rise (SLR), extreme storm events, king tides, and groundwater rise which can occur when higher sea levels cause shallow water tables to rise.
The Water Quality Control Board has amended the Regional Water Board Orders to require dischargers to submit a climate change vulnerability assessment and adaptation plan for the landfill sites. The plan must identify strategies for the long-term protection of the landfill from flooding and inundation due to SLR, groundwater rise, and extreme climate/weather events. This long-term protection plan is due 180 days after the adoption of the Order (October 12, 2022) and must be updated every 5 years thereafter.
In addition, planning for sea level rise and flooding was identified as an action item in the City’s 2021 Climate Action Plan as an adaption strategy for improving community-wide preparation and response to hazardous conditions. There are currently no sea level rise adaptation plans for the Tony Lema landfill area.
Analysis
Terraphase Engineering is a consultant with an existing contract with the City’s Public Works Department for an environmental design and permitting project at the Treatment Wetlands, and this project represents a logical expansion of that existing contract. They not only have the capabilities to conduct the climate vulnerability assessment and prepare the protection plan within the narrowly prescribed mandated timeline, but also are deeply familiar with the site and highly specialized regulatory requirements involved with performing the assessment, thereby making them uniquely qualified to perform the work successfully.
Previous Actions
Terraphase Engineering is an existing vendor with the City with a contract of $911,239 with the Public Works Department for environmental design and permitting services for the Treatment Wetlands.
Legal Analysis
The vendor has agreed to the terms of the City’s standard professional services agreement.
Fiscal Impacts and Budget Authority
This climate vulnerability assessment and flooding plan will require a Council appropriation of $37,290 for Fiscal Year 2022-2023 from the Shoreline Enterprise Golf Course Fund (596) in Account 596-56-002-5120. The project will be funded as follows:

• Total: $37,290
The new regulatory requirements that necessitated the proposed work were unknown at the time the current fiscal year budget was developed, and so funding was not included in the existing budget. Therefore, City Council action is required to adopt the contract and to appropriate $37,290 from the Shoreline Enterprise Golf Course Fund’s undesignated fund balance, resulting in no General Fund impact. There are sufficient funds in the Enterprise Golf Course fund balance to cover this appropriation request.
