RECOMMENDATIONS
Staff recommends acceptance of the work, filing of the Notice of Completion, and authorizing the City Manager to release the maintenance bonds for the subject project upon successful completion of the one-year maintenance period.
 
BACKGROUND
On May 2, 2011, the City Council awarded the construction contract for the subject project to Blossom Valley Construction.  Construction is now complete and is in compliance with the contract documents.  
 
This project was originally proposed to the City by a local community group known as Four Paws Society because the City had no fenced off-leash dog park.  The City's Recreation and Parks Commission determined that such a park would be a benefit to the community and asked the City to add it as a Capital Improvement Program project.  During the course of the design, staff updated the various stakeholders, including presentations to the Recreation and Parks Commission, Facilities and Transportation Committee and the Four Paws Society, through its spokesperson.
 
The new park is located on the City's Shoreline Recreation Area south of Marina Park, adjacent to the East Bay Discharge Authority facility and the Tony Lema Golf Course.  The area was designated for off-leash dog activities, but was not fenced and had no amenities.  The park includes separate small and large dog fenced areas.  Shade structures with tables, drinking fountains, benches, picnic tables, and trash receptacles were included.  The gravel access roadway was also relocated.
 
Analysis
Project construction is complete.
 
Previous Actions
·      On June 1, 2009, by Resolution No. 2009-070, the City Council allocated $50,000 of Park Development Fees for the construction of the Dog Walking Park as part of the 2009-2010 budget
·      On June 7, 2010, by Resolution 2010-060, the City Council allocated an additional $312,000 of Park Development Fees for the construction of the Dog Walking Park as part of the 2010-2011 budget
·      On March 21, 2011, by Resolution 2011-064, the City Council approved the plans and specifications and called for bids
·      On May 2, 2011, by Resolution 2011-086 the City Council awarded a construction contract to Blossom Valley Construction

Applicable General Plan Policies
The project complies with General Plan Goal 22.03 regarding the Development of New Parks.  The project provides recreational opportunities to a user group (dog owners) that was underserved by our parks and recreational facilities, none which had off-leash areas for dogs.
 
Permits and/or Variances Granted
An amendment to the existing Bay Trail permit with the BCDC was obtained to allow for the construction of the park.  
 
Environmental Review
A CEQA Negative Declaration for this project was filed with Alameda County on July 23, 2010.  
 
Code Compliance Review
Work complied with all applicable building codes.  The pre-fabricated shade structure manufacturer obtained a City building permit.
 
Board/Commission Review and Actions
·      December 2009, the Recreation and Park Commission (RAPC) submitted recommendations to the City Council to use part of the Measure WW funds and Park Development Fee (PDF) funds to fund the dog park project
·      September 2009, City Council directed RAPC to determine the best use of WW and PDF funds by including public input
·      October 2008, RAPC sent a letter to City Council with its findings
·      September 2007, City Council directed RAPC to research the feasibility of a Dog Park
 
Summary of Public Outreach Efforts
·      Plans were provided to the Four Paws Society for comment and presented to the RAPC on March 2, 2011
·      A Public Notice was posted at the project site for 30 days in December 2010 in compliance with the application for a BCDC permit
·      A Public Meeting was held at the project site on June 21, 2008
 
Fiscal Impacts
A summary of the construction contract with Blossom Valley Construction is listed below:

The Knight Memorial Fountain at Marina Park was added to this project as a change order.  The fountain includes decomposed granite and concrete pathways to meet Building and ADA requirements.  
 
Public Works Services estimates the annual maintenance cost of the park at $21,849.
 
Budget Authority
The project was included in the Capital Improvement Program (CIP) in both the 2009-2010 and 2010-2011 fiscal years, and a total amount of $362,000 was provided in CIP Account No. 122-38-314.
