SUMMARY AND RECOMMENDATIONS
Staff recommends that the City Council: 1) Adopt the second reading of the ordinance to add the Bicycle and Pedestrian Advisory Commission to the San Leandro Municipal Code; and 2) Adopt a resolution to add Title 28 - Bicycle and Pedestrian Advisory Commission to the San Leandro Administrative Code.
BACKGROUND
In 2011, the City Council approved Resolution No. 2011-011 permanently establishing the Bicycle and Pedestrian Advisory Commission (BPAC). Section 4 of the resolution authorizes the Director of the Engineering and Transportation Department (re-organized as the Public Works Department) to develop rules and procedures and administer the BPAC.
On November 18, 2024, an ordinance to amend and add the BPAC to the San Leandro Municipal Code was introduced for First Reading by the City Council.

The ordinance introduced for First Reading by the City Council on November 18th revises sections of San Leandro Municipal Code Chapter 1-3, as follows:

The ordinance publishes the addition of Article 18 to San Leandro Municipal Code Chapter 1-3, as follows:

Approval of the ordinance and resolution will formalize and codify the BPAC’s rules and procedures, its members, and their powers and duties.

Bicycle and Pedestrian Advisory Commission (September 24, 2024)
• The current BPAC was briefed regarding the proposed commission size, term limits, powers and duties, and timeline for approval and future appointments. The Commission provided input and feedback regarding scheduling and frequency of meetings in addition to consideration of an overall goal and vision of the BPAC.
City Council Rules Committee (October 23, 2024)
• No comments related to addition. Recommendation of approval to City Council for first reading of ordinance scheduled for the November 18th Council meeting

The City Attorney reviewed, conducted legal research, drafted, and approved the ordinance, resolution, and edits to this staff report.
Financial Impacts
There is no new fiscal impact in the adoption of this resolution.
