SUMMARY AND RECOMMENDATIONS
 
This contract provides for the reconstruction of the following residential streets: Amherst Court, Dabner Street, Georgetown Avenue, Graham Way, Hannover Street, Sidney Avenue, and Victor Avenue.  The Contract also includes installation of speed cushions on various city streets as part of the 2013-14 neighborhood traffic calming program.
 
Staff recommends award of a contract to the lowest responsible bidder, Gallagher and Burk, Inc., in the amount of $1,012,665.00 for the Base Bid and Bid Alternate "A" for this project.  Staff also recommends the City Council approve, as part of this project, an appropriation of $136,950.00 in Developer Fees for Street Improvements (DFSI) funding to cover the cost of installing speed cushions.
 
BACKGROUND
 
The street maintenance program is historically underfunded. As a result, the City has primarily performed pavement reconstruction work on streets that carry high traffic volumes and deferred maintenance of residential streets.  In 2013, in response to public concerns and Council direction, staff began allocating a larger portion of our maintenance budget to residential streets.  Pursuant to that change, this project will perform pavement reconstruction on only residential streets. This project was originally scheduled for construction in 2014 but was delayed to accommodate planned utility upgrades and therefore minimize restoration damage for select streets within the project area.
 
Street reconstruction consists of installing a new asphaltic concrete (AC) pavement section on a cement stabilized base.  This rehabilitation method costs significantly less than traditional road reconstruction methods due to reduced raw materials and hauling cost.  
 
The bid documents include an Additive Bid Item "A" for raising and lowering of East Bay Municipal Utility District (EBMUD) water valve access lids that are in conflict with the proposed paving.  This work was separated from the base bid so that it could be removed from the contract in the event that EBMUD decides to complete this work with its own personnel.
 
Analysis
 
Bids were opened on May 21, 2015.  One bid was received and determined to be responsive.  The Engineer's pre bid estimate for the work was $893,823.00.  Gallagher and Burk, Inc.'s low bid is $1,012,665.00.  
 
The listed bid prices include base bid plus bid alternate one as follows:
 
Base Bid:.      $999,665.00
Additive Bid Item A (EBMUD Valve Adjustment):      $13,000.00
Total:      $1,012,665.00
 
Additive Bid Item A for the adjustment of EBMUD water valves will be included as part of the contract and EBMUD will reimburse the City for this work.  
 
This project is not subject to the San Leandro Local Business Preference and Participation Ordinance because it is funded by Measure B.  The low bidder, Gallagher and Burk, Inc., is not a San Leandro business and is not employing local subcontractors.
 
Applicable General Plan Policies
 
This action is consistent with Streets and Highways Goal No. 16 of the General Plan and Action Item 16.03:  Regularly maintain City streets and traffic control devices to ensure that streets operate safely and efficiently.
 
Permits and/or Variances Granted
 
An encroachment permit from the California Department of Transportation will be obtained for work to replace ramps and paving at the southern end of Dabner Street at the intersection of Davis Street (Caltrans Highway 61).
 
Environmental Review
 
This project is categorically exempt from CEQA per Section 15301(c) - Existing Facilities.  A CEQA Categorical Exemption for this project was filed with Alameda County on December 16, 2013.  
 
Summary of Public Outreach Efforts
 
This project was posted on the City's website and advertised in the Daily Review as well as three other newspapers whose circulation reflects the diversity of San Leandro on May 7, 2015.  Notification of this bid opportunity was also sent to local Builder's Exchanges as well as contractors who registered with the City to be informed of bidding opportunities.  
 
The contractor will distribute flyers along the project street segments before work commences.
 
Fiscal Impacts
 
Total project cost is anticipated to be $1,358,203.00 including design, construction management, inspection, and construction contingencies.  
 
Budget Authority
 
This project is funded by the following existing appropriations:
·      $835,966.00 from Measure B Streets and Roads in account No. 144-38-353 appropriated as part of the 2013-14 CIP budget, including a $70,000 budget adjustment made in 2014-15.
·      $304,705.00 from Vehicle Registration Fees in Account No. 143-38-353 appropriated as part of the 2013-14 CIP budget.
·       $60,000.00 from Residential Street Set Aside in Account No. 142-38-357, appropriated as part of the 2013-14 CIP budget.
·      $20,582.00 from Neighborhood Traffic Calming in Account No. 120-28-167 which is a portion of the $147,347 that was appropriated as part of the 2013-14 CIP budget.
 
Additional funding will be appropriated by this action as follows:
 
·      $136,950.00 from the Developer Fees for Street Improvements (DFSI) fund balance will be added to the existing balance in Account No. 120-28-167, Neighborhood Traffic Calming, for use on this project.
