SUMMARY
Pursuant to City Charter Section 305(g), Mayor González seeks City Council approval for the establishment of an ad hoc committee related to existing litigation (Robustelli v. City of San Leandro, Case No. 25CV126732).
BACKGROUND
The City of San Leandro City Charter describes the powers and duties of the Mayor, which include the authority under City Charter Section 305(g) to establish and dissolve ad hoc committees, subject to approval by the City Council.
An ad hoc committee is a temporary body composed of less than a quorum of the City Council that serves a limited or single purpose, is not perpetual, and is dissolved once its specific task is completed. As such, ad hoc committees are not subject to the Brown Act.
Mayor González is requesting that the City Council approve the establishment of an ad hoc committee related to existing litigation (Robustelli v. City of San Leandro, Case No. 25CV126732). The purpose of the proposed ad hoc committee is to engage in more frequent and detailed discussions with legal counsel regarding the Robustelli litigation. The committee will consist of no more than three Councilmembers and will remain in effect for the duration of the litigation.
If the Council approves formation of the Ad Hoc Committee, the Council will also select three members to serve on the committee. The committee may be composed of any combination of Councilmembers and/or the Mayor.
Current Agency Policies
City Charter Section 305(g), Powers and Duties of the Mayor:
• “The Mayor shall be the political head of the City. The Mayor shall […] establish and dissolve ad hoc committees, subject to approval by the Council.”
Financial Impacts
This Council action will not impact fund balance because there are funds available in the FY 2025-2026 adopted budget.
