Motion for Reconsideration of Council Action Taken at the regular meeting on May 18, 2026 to Accept an Urgency Referral Pertaining to a Resolution Reaffirming the City Council's Intent Regarding Rehabilitation of Lake Chabot Road, to be Considered at a July City Council Meeting

SUMMARY
As provided for in the City Charter, Mayor González filed a Notice of Suspension with the City Clerk after the May 18, 2026 City Council meeting. This suspends the City Council’s action that was taken to accept an urgency referral to consider a Resolution at a City Council meeting in July that would reaffirm the City Council’s intent regarding rehabilitation of Lake Chabot Road. The City Council must now vote on whether to reconsider its earlier decision. After that vote, the Council may discuss and reconsider the original action.
RECOMMENDATIONS
In accordance with San Leandro Charter Section 305(h), the City Council must:
1. Vote upon the Mayor's Motion for Reconsideration; and
2. If the Motion for Reconsideration passes, the City Council may then reconsider the original action taken on May 18, 2026, which was a vote to accept an urgency referral to consider a Resolution at a City Council meeting in July that would reaffirm the City Council’s intent regarding rehabilitation of Lake Chabot Road.
BACKGROUND
Suspended Action
On May 18, 2026, Vice Mayor Viveros-Walton submitted an urgency referral for consideration by the City Council (Attachment A). The referral pertained to a Resolution reaffirming the City Council’s intent regarding rehabilitation of Lake Chabot Road, to be considered at a City Council meeting in July.
The City Council’s policy for submitting future agenda items and urgency referrals is established in the City Council Member Handbook, most recently adopted by Resolution No. 2025-117 on September 8, 2025. The policy is as follows:
“All City Council items brought forward at City Council meetings under “Council Requests for Future Items” shall be added to the City Council Priority List to be prioritized at a subsequent City Council planning retreat or session. An exception to the normal referral process is defined as an urgency referral. Urgent referrals should be used most judiciously to support the capacity necessary to complete the Council’s identified priorities.
Items referred by Council as Urgent Matters shall be prioritized ahead of other already established priorities and will impact staff’s progress on other high priority projects. An urgent referral must meet the following criteria and be defined as part of the referral: The criteria for urgency is defined as an action necessary to immediately preserve the life, health and safety of the community, or failure to respond in an expeditious manner could result in harmful legislative or financial consequences for the city. Because no discussion is allowed on the nature of the urgency, an urgent referral requires a 2/3 vote, which is 5 members of the Council to move forward with the urgency referral.
All requests made shall be submitted to the City Manager and City Clerk in writing and in advance of the City Council meeting, to ensure the correct language for the permanent record.”
A motion was made by Vice Mayor Viveros-Walton, seconded by Councilmember J. Aguilar, to accept the item as an urgency referral. The motion carried by the following vote:

Mayor’s Notice of Suspension
City Charter Section 305(h) authorizes the Mayor to suspend implementation of any action taken by the Council by filing with the City Clerk, within three days after such Council action, a notice of suspension thereof. Such suspension shall constitute a Motion for Reconsideration of the action taken, to be voted upon by the Council at its next regular meeting.
On May 20, 2026, Mayor González filed a Notice of Suspension with the City Clerk to reconsider the action taken on May 18, 2026 regarding the urgency referral (Attachment B). Accordingly, implementation of the Council action taken on May 18, 2026 has been suspended, and the matter has been scheduled for this June 1, 2026 City Council meeting.
To reconsider this matter, the City Council must vote on the Mayor's Motion to Reconsider. If the Motion to Reconsider passes, the City Council may then reconsider the motion to accept the item as an urgency referral.
