SUMMARY & RECCOMENDATIONS

 

The current Joint Powers Agreement for the Alameda County Abandoned Vehicle Program had a sunset date of May 31, 2023.  The City of San Leandro has been a member since its inception in 1993.  The City of San Leandro desires to remain a member of the organization.

 

Staff recommends adopting the attached resolution extending the abandoned vehicle abatement program until May 31, 2033.

BACKGROUND

 

In 1990, the California State Legislature enacted legislation allowing for the creation of county-based vehicle service authorities, pursuant to the provisions of Vehicle Code Section 22710.  In 1993, the Alameda County Abandoned Vehicle Abatement Authority (Alco AVA) was formed and imposed a one-dollar annual vehicle registration fee on vehicles registered to an owner with an address in Alameda County. 

 

Vehicle registration fees are collected by the Department of Motor Vehicles and allocated to the Alco AVA by the State Controller’s Office pursuant to Vehicle Code Section 9250.7.  Fees are then allocated to the Alco AVA participating agencies based on an adopted formula involving their individual percentage of vehicles abated, population and land area in relation to the totals for these factors in the Alco AVA as a whole.  The current participating agencies are the County of Alameda, and all of the Alameda County cities except Albany and Emeryville.  

 

Since the inception of the program, the Alco AVA has received approximately $34.8 million, which has allowed the participating agencies to abate approximately 465,000 abandoned vehicles. Since 2013 the City of San Leandro has received approximately $870,000.00 dollars and towed approximately 1,200 abandoned vehicles. 

 

The current program was set to expire at the end of May 2023.  Legislation allows the local service authorities to extend the program every 10 years with the approval of the County and a majority of the cities comprising a majority of the population of the incorporated areas.  Adoption of the attached resolution is the first step towards the extension of this important program.

 

 

Analysis

 

Alco AVA cannot exist without authorization by a majority of cities representing a majority of the incorporated population in Alameda County. The cities adoption of their own respective resolutions in 2013 re-authorized for 10 years the existence of Alco AVA. They then distribute funds collected from registration fees to cities in the county to fund their abandoned vehicle abetment programs.

 

Previous Actions

 

The City Council approved resolutions to become a participating City in the program on December 30, 1991 (Resolution Nos. 91-259 and 91-260), on June 15, 1992 (Resolution No. 92-158), on May 17, 1993 (Resolution No. 93-010), on July 15, 2002 (Resolution No. 2002-112), and Resolution No. 12-475 was adopted on October 15, 2012, which extended the City’s participation until May 2023. 

 

Financial Impacts

 

Since 2013 the City of San Leandro has received approximately $920,000 dollars in revenue.  The revenue when received is deposited into the General Fund via trust account number 010-3811 as required by legislation.
