Staffreport

SUMMARY AND RECOMMENDATIONS

Staff recommends that the City Council adopt a resolution to approve Amendment No. 1 to the City Manager’s employment agreement between the City of San Leandro and Frances Robustelli, as presented.

BACKGROUND

On May 3, 2021, the City Council approved an Employment Agreement with Frances Robustelli providing the terms and conditions of her employment as the City Manager. The Agreement was for a period of three (3) years commencing on May 4, 2021.

Analysis

In May of 2022, the City Council completed its first evaluation of the City Manager’s performance and determined, based on a positive performance review, to amend the City Manager’s Employment Agreement. The proposed Amendment No. 1 to the City Manager’s Employment Agreement makes the following changes:

•                     Extend the term for an additional two (2) years through May 3, 2026

•                     Increase the base annual salary by 3% effective June 1, 2022

•                     Increase the vacation accrual from 3 weeks to 5 weeks per year

•                     Provide the vacation cash out option available to the San Leandro Management Organization

•                     Perform a salary survey in November 2022

On January 1, 2022, the City Manager received a 3% salary adjustment. Providing an additional 3% salary adjustment effective June 1, 2022 will make the City Manager’s increase comparable to the 6% salary adjustment received by employees in the San Leandro Management Organization and San Leandro City Employees Association. This salary adjustment and other provision changes recognizes the performance of the City Manager, maintains external competitiveness within the labor market, and addresses internal compaction issues. The City Manager has been contributing 10% of salary towards pension costs and will continue to do so going forward.

The salary schedules have been revised to reflect the salary adjustment and are presented in accordance with California Code of Regulations Section 570.5, which requires that salary schedules be in a format that identifies the position title, the payrate, the effective date, the range, and be duly approved and adopted by the governing body.

Previous Actions

On May 3, 2021, by Resolution No. 2021-070, the City Council approved an employment agreement with Frances Robustelli to serve as City Manager.

Financial Impacts

The 3% salary increase represents a budget increase of approximately $10,188 for Fiscal Year 2022-2023, which will require Council appropriation from the General Fund Undesignated Fund Balance to the corresponding salary allocation account.
