AN ORDINANCE OF THE CITY OF SAN LEANDRO CITY COUNCIL TO REPEAL AND ADOPT THE CALIFORNIA BUILDING STANDARDS CODE
The City of San Leandro City Council does ORDAIN as follows:
Section 1. ORDINANCE
Article 10A of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Residential Building Code,” is hereby repealed and replaced in its entirety by Article 10A, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2019 California Residential Building Code, as published by the International Code Council, adopted by reference and made a part hereof as if fully set forth herein at length, to be known as the City of San Leandro “Residential Building Code”; and
Article 9 of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Plumbing Code,” is hereby repealed and replaced in its entirety by Article 9, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2019 California Plumbing Code, as published by the International Association of Plumbing and Mechanical Officials, adopted by reference and made a part hereof as if fully set forth herein at length, to be known as the City of San Leandro “Plumbing Code”; and
Article 7 of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Energy Code,” is hereby repealed and replaced in its entirety by Article 7, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2019 California Energy Code, as published by the International Code Council, adopted by reference and made a part hereof as if fully set forth herein at length, to be known as the City of San Leandro “Energy Code”; and
Article 6 of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Green Building Standards Code,” is hereby repealed and replaced in its entirety by Article 6, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2016 California Green Building Standards Code, as published by the International Code Council, adopted by reference and made a part hereof as if fully set forth herein at length, to be known as the City of San Leandro “Green Building Code”; and
Article 5 of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Electrical Code,” is hereby repealed and replaced in its entirety by Article 5, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2019 California Electrical Code, as published by BNi Publications, Inc. adopted by reference and made a part hereof as if fully set forth herein at length, to be known as the City of San Leandro “Electrical Code”; and
Article 4 of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Mechanical Code,” is hereby repealed and replaced in its entirety by Article 4, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2019 California Mechanical Code, as published by the International Association of Plumbing and Mechanical Officials, adopted by reference and made a part hereof as if fully set forth herein at length, to be known as the City of San Leandro “Mechanical Code;” and
Article 8 of Chapter 5 of Title VII of the San Leandro Municipal Code, “California Fire Code,” is hereby repealed and replaced in its entirety by Article 8, Chapter 5 of Title VII of the San Leandro Municipal Code, the 2019 California Fire Code, as published by the International Code Council, adopted by reference as if fully set forth herein at length, and by the document attached hereto and made a part hereof, to be known as the City of San Leandro “Fire Code.”
Section 2. EFFECTIVE DATE
The effective date of this ordinance shall be January 1, 2020.
Section 3. SEVERABILITY
The City Council hereby declares that every section, paragraph, clause and phrase of this Ordinance, and all Ordinance text adopted by reference, are severable. If, for any reason, any section, paragraph, clause or phrase is held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining sections, paragraphs, clauses or phrases.
Section 4. PUBLICATION
The City Clerk for the City of San Leandro shall publish this Ordinance in accordance with all laws and regulations governing the publication of ordinances that pertain to the adoption of the California Building Standards Code.
