RESOLUTION of the City of San Leandro City Council to Authorize the City Manager to Execute and Pay $87,000 for a Public Highway and Pedestrian At-Grade Crossing Agreement with Union Pacific Railroad Company; and Appropriate Additional Grant Funding of $493,738 for the Washington/Chapman Railroad Crossing Improvements Project; Project No. 2016.0320 (provides for an agreement that will allow City to make pedestrian safety enhancements at the subject railroad crossing)

WHEREAS, a Public Highway and Pedestrian At-Grade Crossing Agreement (Crossing Agreement) between the City of San Leandro and Union Pacific Railroad (UPRR), for the at-Grade Highway-Rail Crossing, DOT No. 749743X, in the City of San Leandro, Alameda County, for the Niles Subdivision at the Washington Avenue-Chapman Road UPRR crossing, a copy of which is attached hereto and incorporated herein by reference, was presented to this City Council; and
WHEREAS, the Crossing Agreement permits the expansion of crossing improvements to include new sidewalk alignments and sets forth responsibilities for construction of improvements; and
WHEREAS, the Crossing Agreement obligates the City to pay a lump sum fee of $87,000 to UPRR for right-of-way access; and
WHEREAS, at completion of construction, all previous agreements for this crossing location shall terminate and the terms and conditions of this Agreement shall govern use, maintenance, and repair of the Washington Ave. at-grade road crossing; and
WHEREAS, Grant Amendment Nos. 1, 2, and 3 providing additional grant funding of $493,738 and term extension have been presented to this City Council; and
WHEREAS, the City Council is familiar with the contents of the Crossing Agreement and Grant Amendments; and
WHEREAS, the City Manager recommends approval of said Crossing Agreement and Grant Amendments.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That said Public Highway and Pedestrian At-Grade Crossing Agreement with Union Pacific Railroad for Improvements, Use, Maintenance, and Repair of the Washington/Chapman Railroad Crossing of the Niles Subdivision is hereby approved, and execution by the City Manager is hereby authorized; and
2. That payment of a lump sum fee of $87,000 to UPRR for right-of-way by the City Manager is hereby authorized; and
3. Grant Amendments 1, 2, and 3 are approved and additional grant funding of $493,738 is hereby appropriated to account 150-38-387.
