SUMMARY

 

Amends an existing consulting services agreement to add scope and fee related to changes in schedule and duration of the bridge removal work.

 

RECOMMENDATIONS

 

Staff recommends approval of Amendment 2 to the agreement with Terraphase Engineering, Inc.

 

BACKGROUND

 

A pedestrian bridge over San Leandro Creek that connects Cary Drive with Haas Ave was severely bent and knocked off the abutments during a windstorm in March, 2023 when two trees fell onto it. The City subsequently hired Terraphase Engineering, Inc to provide biological studies required for work permits and also to apply for and coordinate permitting with the agencies that regulate work in the creek. An amendment to the agreement with Terraphase added monitoring of the work during construction as required by the permits and to ensure habitat, plants, and animals are protected. 

 

The City hired McGuire and Hester, a contractor based in Oakland, to remove the bridge. Permits for the work were obtained in December, 2023 contingent upon both dry weather and an accelerated construction schedule that required the contractor to work overtime and 7 days a week. In anticipation of the work, Terraphase performed pre- construction animal surveys. Unfortunately, the winter of 2023-2024 contained no suitable period of dry weather, the work was not completed, and the work is now scheduled to start at the end of July, 2024. The work will occur during the dry season so the contractor does not need to accelerate the work and overtime is not anticipated. This will result in less fees paid to the contractor but there will be more days of work and the biologist will need to be on site up to five additional days. Additionally, the pre- construction animal surveys from last December are no longer valid and must be redone.

 

Analysis

 

The original contract and first amendment to the contract with Terraphase resulted in a fee of $93,513, which is below the threshold of $100,000 that requires City Council approval. The second amendment to the contract, to cover resurveying for animals and additional days of biological monitoring brings the contract total to $108,653 and requires City Council approval. 

 

Terraphase has prepared the biological mitigation plan and is in contract to observe the construction for 10 days. They are the only suitable firm to contract with for the remaining construction period of up to 5 additional days. The consultant has agreed to the terms of the contract.

 

Previous Actions

 

                     On September 5, 2023, by Resolution No. 2023-121 the City Council awarded a contract to McGuire and Hester for bridge removal.

 

Permits and/or Variances Granted

 

Permits for removal of the bridge from San Leandro Creek have been granted by the Alameda County Flood Control District, the Army Corps of Engineer, the California Department of Fish and Wildlife, and the Regional Water Quality Board.

 

Environmental Review

 

This project is categorically exempt from an environmental impact evaluation per Section 15301, class 1. 

 

Financial Impacts

 

$650,000 is budgeted for this project and the current cost estimate is $400,000. Therefore, sufficient FY 2023-2024 carryover funds are available to allocate for the contract amendment of $15,140.

This Council action will not impact fund balance because funds were previously appropriated.
