SUMMARY AND RECOMMENDATIONS

 

Staff recommends that the City Council adopt a Resolution approving Parcel Map 11257 for 3081 & 3089 Teagarden Street, a single-lot subdivision for nonresidential condominium purposes.

 

BACKGROUND

 

The subject property is located on the south side of Teagarden Street between Alvarado Street and Fairway Drive. The property is owned by DS Real Property Investors LLC and includes two existing units within an existing industrial building. The two units are separated by a shared wall and are within one lot.  Many of the existing buildings in this area have a similar configuration. The land is currently zoned as IG, Industrial General, which allows for this configuration.

 

Analysis

 

Although two units currently exist in the existing industrial building on the property, the owner would like to subdivide the land with a condominium map so each unit can be individually owned.  The lot is 48,352 square feet (1.1 acres) and will be subdivided into two condominium parcels within the building (units 1 and 2 that are consistent with the existing tenant spaces in the building) and one common interest parcel.  The maintenance responsibilities of each unit and the surrounding common interest parcel area will be defined in a Conditions, Covenants, and Restrictions (CC&Rs) document. A copy of the CC&Rs is attached to this report.  The owner has agreed to satisfy the Conditions of Approval for Planning Permit PLN21-0035 at a later date; the agreement will be filed with the County Recorder.  The developer has not provided a bond or other security to ensure performance.

 

City Planner’s Review: The City Planner examined the Parcel Map in relation to the zoning and similar General Plan and Specific Plan policies and goals.  The attached City Planner’s report confirms adherence to these requirements.

 

City Engineer’s Findings: The City Engineer examined Parcel Map 11257 and found that it complies with California law and local ordinances. In addition, the City’s consulting Land Surveyor is satisfied that Parcel Map 11257 is technically correct pursuant to California Government Code §66450(b).

Previous Actions

 

                     On February 4, 2022, the Board of Zoning Adjustment approved Planning Application PLN21-0035, a Nonresidential Condominium Conversion Application. Parcel Map 11257 conforms to this earlier approval.

 

                     On February 2, 2017, the Board of Zoning Adjustments (BZA) approved Conditional Use Permit to establish an approximate 7,704 square foot medical cannabis dispensary within an existing commercial building at 3089 Teagarden Street, subject to Conditions of Approval, for PLN17-0012.

 

Applicable General Plan Policies

 

Policy LU-7.2 - Adaptive Reuse: Encourage private reinvestment in vacant or underutilized industrial and commercial real estate to adapt such property to changing economic needs, including the creation of flex/office space and space for technology-driven businesses.

 

Policy LU-7.3 - Zoning Flexibility: Ensure that industrial zoning regulations are flexible enough to achieve the vision of San Leandro’s industrial area as an “innovation ecosystem”, where new methods of production, operations, and design are supported development.

 

Policy ED-2.7 - Small Business: Create a supportive environment for small businesses, particularly locally-owned retail and service businesses Downtown and in the city’s neighborhood centers.

 

Policy ED-3.8 - Sharing Economy: Explore ways in which new San Leandro businesses and start-ups can benefit from the sharing economy, including the sharing of business and industrial space, vehicles, and services that are more affordable when shared by multiple users.
