SUMMARY

 

Resolution to approve an Assignment, Assumption, and Release Agreement between the City of San Leandro, Family Service of San Leandro, and Hively, for the Lease of the City-owned property at 2208 San Leandro Boulevard. Hively acquired Family Service of San Leandro (FSSL) and is continuing the same programs, offering mental health services to medical eligible clients in Alameda County.

 

RECOMMENDATIONS

 

Staff recommends that the City Council approve a resolution that approves an agreement in which Family Service of San Leandro assigns, and Hively assumes the lease of the City-owned property at 2208 San Leandro Boulevard.

 

BACKGROUND

 

In 1997 the City of San Leandro entered into a lease agreement with Family Service of San Leandro for City-owned property at 2208 San Leandro Boulevard. The lease had a term of 15 years for an amount of one dollar per year. As a nonprofit, FSSL worked to assist in the strengthening of family life through professional, affordable counseling.

 

In 2012, the City entered into a new lease with FSSL. The lessee is responsible for all maintenance, repairs, utilities, taxes and other costs of operating the facilities. In 2019, following a full roof replacement by the lessee, the lease was amended to provide an additional 15 years, through 2034. The full rent of $100 per year was due in advance for the lease term, a total amount of $1,500.

 

Family Service of San Leandro and all its assets and real estate was acquired by Hively, which has continued to provide the same social service at the location. At this time, Hively has requested that the lease be assigned and placed under their name. The lease permits assignments with City Council approval.

 

Analysis

 

In the same manner as Family Service of San Leandro, Hively provides mental health services to medical eligible clients in San Leandro and across Alameda County. Hively is a California nonprofit public benefit organization formed to provide resources, programs and services that strengthen and support children and families. 

 

Hively serves families through childcare stipends and referrals, family resource navigation, parent education classes, and clinical mental health services. Hively Mental Health offers counseling services in three Alameda County locations for all ages, toddler to adult, via Medi-Cal and private pay options. Their clinicians are licensed marriage and family therapists and pre-licensed trainees. 

 

Since 1997, Family Services of San Leandro and now Hively, has provided affordable, high quality, professional counseling services for a variety of challenges affecting the emotional health and wellbeing of individuals and their families. In their office at 2208 San Leandro Boulevard, there are four dedicated therapy rooms for counseling services and a waiting room for clients that can also be used for group therapy.  Clients can also receive information about other Hively services and resources including childcare stipends and parent education.  

 

Staff recommends that the City Council approve a resolution that approves an agreement in which Family Service of San Leandro assigns, and Hively assumes the lease of the City-owned property at 2208 San Leandro Boulevard, so that they may continue to provide valuable services to the community.

Legal Analysis

 

The City Attorney has drafted in part the Agreement and approved it as to form.

 

Financial Impacts

 

No fiscal impact as to cost is anticipated. The lessee shall, at its own cost and expense, maintain the premises and structure in good order and safe, sanitary and clean condition. The lessee shall pay for the cost of utilities and any taxes or fees that may become due.
