SUMMARY
Staff recommend that the City Council approve and authorize the City Manager to execute a Consulting Services Agreement with Fehr and Peers to complete the Bay Fair Community Based Transportation Plan (CBTP), which is a joint effort between the City of San Leandro and Alameda County. The Bay Fair CBTP addresses community transportation priorities through direct public engagement and will result in a list of recommended capital projects in both the City and County in and around the Bay Fair BART Station area.
The CSA with Fehr and Peers sets a not to exceed amount of $225,000, which is entirely funded through an Alameda County Transportation Commission (ACTC) grant.
The CBTP will complement the concurrent Bay Fair Development Plan and Specific Plan Update work utilizing $1,800,000 in competitive Metropolitan Transportation Commission (MTC) Priority Development Area (PDA) grant funds.
RECOMMENDATIONS
Staff recommend that the City Council adopt a Resolution approving and authorizing the City Manager to execute a Consulting Services Agreement (CSA) with Fehr and Peers in an amount not to exceed $225,000 for preparation of the Bay Fair CBTP.
A CSA for the Bay Fair CBTP was previously authorized and initiated with a different consulting team; however, the City assessed the need to move in a different and more focused project direction and now intends to engage Fehr & Peers to complete the project.
BACKGROUND
The Community Based Transportation Plan (CBTP) program was launched in 2002 by MTC to identify transportation challenges in equity communities around the region and strategies to overcome them. MTC awards CBTP funding to county transportation agencies to administer funding for and development of these community plans on MTC’s behalf. Consistent with MTC’s guidelines to prioritize areas that do not have current or recent plans, ACTC staff identified central Alameda County as an area where there is high equity need in and around MTC’s established equity geographies.
City of San Leandro and Alameda County Community Development Agency staff partnered to develop a proposal to prepare a CBTP for the area surrounding the Bay Fair BART station, including the area in unincorporated Alameda County.
On April 18, 2024, ACTC approved programming and allocation of $350,000 of One Bay Area Grant program (OBAG3) funds to the City of San Leandro for a CBTP that includes a portion of unincorporated Alameda County.
ANALYSIS
To avoid delay and maintain project momentum, staff propose engaging Fehr & Peers to complete the Bay Fair CBTP. While a separate RFP was not issued for this project, the selected consultant, Fehr & Peers, is pre-approved through both the MTC/ABAG Regional Planning Bench and the City’s on-call consultant list for Engineering and Transportation services. Because the initial procurement for a consultant was through a competitive process, and because Fehr and Peers is pre-approved through both the MTC/ABAG Regional Planning Bench and the City’s on-call consultant list for Engineering and Transportation services, the Council finds - under San Leandro Municipal Code Sec. 1-6-315 -- that it is in the City’s best interests to waive the competitive selection process for the award of this contract.
The Bay Fair CBTP augments the Bay Fair TOD Development Plan scope of work and extends the scope into the equity communities of unincorporated Alameda County as part of the larger planning for the TOD area.
Specifically, the CBTP scope of work includes:
• Overall project management and coordination
• Community engagement, including two rounds of outreach with open houses, pop-ups, collaboration with community-based organizations, and an online survey translated into multiple languages
• A list of recommended transportation improvements based on community and stakeholder input
• An implementation strategy with priorities, cost estimates, and project phasing.
• Public draft and final version of the Bay Fair CBTP
Applicable General Plan Policies
The Bay Fair CBTP would advance General Plan Policy LU-8.10, which calls for transforming the area around the Bay Fair BART station into a dynamic new transit-oriented development area. The Bay Fair CBTP would also advance Policy T-2.1 to create and maintain "complete” streets that provide safe, comfortable, and convenient travel through a comprehensive, integrated transportation network that serves all users.
Financial Impacts
The recommended action will be cost neutral because grant funding will cover all expenses on a reimbursement basis. The Council previously appropriated $350,000 in funds into account number 150-41-122 (Bay Fair CBTP Grant).
This action will result in no impact to the General Fund.
