SUMMARY AND RECOMMENDATIONS
 
The San Leandro Unified School District (SLUSD) plans to install a circular walking path from Washington Elementary School around McCartney Park for school use while school is in session and for public use at all times thereafter.  Maintenance of the path will be performed by the City of San Leandro (City) with costs shared equally with SLUSD. Staff recommends the City Council approve the agreement.
 
BACKGROUND
 
The SLUSD requires the City's approval to install a circular walking path from Washington Elementary School around McCartney Park, to be used primarily for physical education purposes when school is in session. The SLUSD seeks to break ground on the project in June 2013, and is seeking City Council approval of an agreement between the City and the SLUSD for the construction, operation, use and maintenance of the pathway when it enters upon City property.  
 
Analysis
 
The SLUSD will install a circular walking path from Washington Elementary School around McCartney Park.  All costs to install the walking path will be paid by the SLUSD.  At present, the walking path ends half way into the park.  Plans include completing a circle to allow students to exercise by walking a circuitous route from the school through the park and back again. The City will maintain the path once completed, and bill the SLUSD half the costs of maintenance.
 
The City and the SLUSD entered into an agreement on March 21, 1960 for the construction and operation of McCartney Park.  Amendments were then executed to share in the costs of maintenance for two years after the park was completed.  The City has maintained the park at its cost since 1963. This action is a continuation of the cooperative relationship between the City and SLUSD for the use of McCartney Park, and will establish maintenance cost-sharing for the pathway.
 
Current Agency Policies
 
This action supports the following City Council goals:  1) Supporting programs that enhance the quality of life and promote a sense of community and civic pride in San Leandro and 2) maintaining and supporting a strong positive relationship between the City and schools.
 
Applicable General Plan Policies
  • 24.02 COMPREHENSIVE APPROACH Consider joint use in the broadest possible context, including recreational programs, capital improvement projects, maintenance, and community outreach as well as the shared use of facilities
  • 24.01 JOINT USE AGREEMENTS Promote joint use agreements between the City and the San Leandro and San Lorenzo Unified School Districts to maximize public access to school recreational facilities and grounds during non-school hours
  • 22.08 TRAILS Encourage the development of additional trails within the City
  • 22.05 PROVISIONS FOR MAINTENANCE Ensure that any proposal for new park or recreational facilities includes a commitment to a high level of ongoing maintenance
 
Environmental Review
 
This project is exempt from CEQA, per CEQA Guidelines Sections 15301 and 15304.  
 
Fiscal Impacts
 
There will be a cost to maintain the path, which will be covered by existing appropriations in the parks maintenance accounts.  Half of these costs will be billed to the SLUSD.
 
Budget Authority
