SUMMARY

 

Staff seek City Council approval to execute a consulting services agreement with Larry Walker Associates, Inc (LWA) for the review of the City’s current Pretreatment Program. The review of the program and implementation support will ensure that the City is compliant with all regulatory requirements. 

 

 RECOMMENDATIONS

 

Staff recommend that the City Council approve and authorize the City Manager to execute a consulting services agreement with LWA for Pretreatment Program Review.

 

BACKGROUND

 

The City is subject to state and federal wastewater regulations under its National Pollution Discharge Elimination System (NPDES) Permit as a member of the East Bay Dischargers Authority (EBDA). As part of the permit, the City is required to regulate industrial discharges to ensure that industrial waste that may be damaging to wastewater infrastructure or otherwise harmful to the environment does not enter the collection system. This regulatory program is commonly called a “Pretreatment Program” because it requires dischargers to treat their wastes before release to the sewer. Review of this regulatory program will ensure that the program meets the City’s obligations.

 

Analysis

 

The City’s Pretreatment Program had been managed by the Environmental Services Section of the Water Pollution Control Division. As this role is transitioned to dedicated staff at Water Pollution Control Plant, it is an opportune time to review the Pretreatment Program. LWA has consultants who are well versed in the regulatory requirements and can review the City’s program to identify any areas for improvement. The agreement also includes an allowance for on-call support to implement the recommended improvements. Depending on the findings, a follow up agreement may also be necessary.

 

The City currently has a contract with LWA for Municipal Regional Stormwater Permit (MRP) compliance support. The City is satisfied with the current engagement with LWA and wastewater is also within the firm’s expertise. It is recommended that the City also execute a consulting services agreement with LWA for support with the City’s Pretreatment Program.

 

Although this agreement falls below the City Manager’s approval authority, the total contracts with LWA in this fiscal year exceed $100,000 triggering Council approval to expend funds over $100,000 to this vendor.

Legal Analysis

 

The consultant has agreed to the terms of the contract.

 

Financial Impacts

 

Sufficient funds are included in the Fiscal Year 2026-2027 Water Pollution Control Fund budget for consulting services:

 

                     Water Pollution Control Fund, Account 593-51-002-5120:                      $35,000

 

This Council action will not impact fund balance because there are funds available in the FY2026-2027 adopted budget.
