Staff Report for a City of San Leandro City Council Resolution to Authorize the City Manager to Enter into a $14 Million Project Funding Agreement with the Alameda County Transportation Commission for Discretionary Funding Provided by the Measure BB Transportation Sales Tax Revenue

SUMMARY AND RECOMMENDATIONS
The agreement will provide $14 Million in Measure BB grant funds to the City for street rehabilitation.
Staff recommends that the City Council approve and authorize the City Manager to enter the City into a Project Funding Agreement with the Alameda County Transportation Commission (Alameda CTC).
BACKGROUND
On November 4, 2014, the voters of Alameda County, pursuant to the provisions of the Local Transportation Authority and Improvement Act, California Public Utilities Code Section 180000 et seq., approved Measure BB, thereby authorizing Alameda CTC to administer the proceeds from the extension of an existing one-half of one percent transaction and use tax scheduled to terminate on March 31, 2022, and the augmentation of that tax by one-half of one percent.
The duration of the tax will be thirty years from the initial year of collection, which began on April 1, 2015, with said tax to terminate/expire on March 31, 2045. The tax proceeds will be used to pay for the investments outlined in the 2014 Alameda County Transportation Expenditure Plan (“2014 TEP”), as it may be amended.
A portion of the annual proceeds is designated for discretionary funding of transportation projects within the County of which $30 Million has been programmed over five fiscal periods for the rehabilitation of San Leandro streets. Between Fiscal Years 2016-2017 and 2017-2018, the City was granted $16 Million from the programmed funds, and a new project agreement must be executed before the City is eligible to receive the remaining $14 Million in grant funds.
Analysis
The terms and conditions of the grant are for two years and the funds will be used exclusively for construction. The City can comply with the terms and conditions of the grant without hardship.
Alameda CTC will permit the use of the City’s local business ordinance on the project; however, they have not yet determined if the use of the City’s community workforce agreement will be permitted.
The agreement attached to the resolution is substantially complete; however, minor changes to the language may occur.
Previous Actions
• On September 18, 2017, by Resolution No. 2017-127, the City Council authorized the City Manager to enter into a $13 Million project funding agreement with Alameda CTC for City streets rehabilitation work.
• On December 5, 2016, by Resolution No. 2016-162, the City Council authorized the City Manager to enter into a $3 Million project funding agreement with Alameda CTC for City streets rehabilitation work.
Applicable General Plan Policies
Policy T 5.3: Maintenance. Regularly maintain City streets and traffic control devices to ensure that streets operate safely and efficiently. The City will strive for an overall Pavement Condition Index of 76, which is the lower limit of industry best practices.
Legal Analysis
The City Attorney’s Office reviewed the agreement, and it is approved as to form.
Fiscal Impacts
Execution of the agreement will provide funds for rehabilitation of City streets.
