RESOLUTION Awarding a Construction Contract to Columbia Electric, Inc. for the Hesperian Boulevard/Springlake Drive Railroad Crossing Improvements, Project No. 12-150-38-325 and Appropriating $180,000 of Measure B Bicycle and Pedestrian Funds for the Project (provides for pedestrian safety equipment including accessible sidewalks, ramps and push button devices at a cost of $236,936.50 funded by the Measure B Bicycle and Pedestrian Fund and the Section 130 Federal Grant)
 
Body
WHEREAS, the City of San Leandro did, on August 12, 2014 publicly open, examine and declare all sealed proposals or bids for doing the work described in the bid documents for the subject project; and
 
WHEREAS, Measure B Bicycle and Pedestrian funds will be used for this program; and
 
WHEREAS, said proposals were submitted to the Engineering and Transportation Director who has found that the proposal hereinafter mentioned is the lowest responsive bid by a responsible bidder for doing said work.
 
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
 
1.      That said City Council hereby rejects all of said proposals or bids except that herein mentioned; hereby waives any irregularities in the proposal or bid of the lowest responsible bidder; and hereby awards the contract for doing said work to the lowest responsible bidder therefore, to wit Columbia Electric, Inc. in the amount of $236,936.50; and
 
2.      That $180,000 of Measure B Bicycle and Pedestrian funds are appropriated for the completion of the project; and
 
3.      Furthermore, in the event that the above named contractor is unable to execute the contract, then the City Council takes notice that the City has complied with the public bidding laws of the California Public Contract Code for this project, and the City is no longer required to engage in competitive bidding to award any subsequent contract for the aforementioned work.
