RECOMMENDATIONS
 
Staff recommends acceptance of the work, filing of the Notice of Completion, and authorizing the City Manager to release the maintenance bond for the subject project upon successful completion of the one-year maintenance period.
 
BACKGROUND
 
The original park restroom, constructed circa 1962, did not comply with Americans with Disabilities Act (ADA) requirements and, after nearly 50 years of service, required significant efforts each year to maintain it.  Additionally, the original architecture created blind spots that were perceived by some as unsafe.
 
The site preparation for the replacement facility and demolition of the old structure was done under this contract.  A pre-fabricated building was purchased and installed under a separate contract.  
 
Analysis
 
Construction is now complete and was performed in compliance with the contract documents.  The work included all necessary site preparation for placement of the pre-fabricated restroom building.  Such preparations included:  1) preparation of the new building sub-grade; 2) relocation of utility connections; 3) installation of a new accessible parking stall; 4) installation of a new drinking fountain; and 5) other miscellaneous site work.  
 
Previous Actions
 
·      On June 18, 2007, by Resolution No. 2007-078, the City Council adopted the budget for Fiscal Year 2007-2008 that provided CIP funds in Account No. 210-62-008
·      On December 6, 2010, by Resolution 2010-146, the City Council authorized a sole-source contract with Public Restroom Company to provide a pre-fabricated restroom for the subject project
·      On May 16, 2011, by Resolution 2011-091, the City Council approved Plans and Specifications and called for bids on the subject project
·      On June 20, 2011, by Resolution 2011-128, the City Council awarded a construction contract to the low bidder, McNabb Construction, for the subject project
 
Committee Review and Actions
 
The project was presented to the Facilities and Transportation Committee during the project update on June 8, 2010.
 
Applicable General Plan Policies
 
Conforms to General Plan Goal 21.01, which encourages both renovation and ADA upgrades of City parks.  
 
Permits and/or Variances Granted
 
This project obtained a City electrical permit for the new electrical service to the pre-fabricated restroom.
 
Environmental Review
 
This project was determined to be exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15302.
 
Code Compliance Review
 
A City electrical permit was obtained to install the electrical service for the new restroom.
 
Summary of Public Outreach Efforts
 
A community workshop was held on July 22, 2010 to solicit input from the community on the KaBOOM! playground (Project No. 150-62-008).  At that meeting, information on the proposed restroom and location was provided for public review and comment.
 
Fiscal Impacts
 
·      The total project cost (including the pre-fabricated restroom building) is approximately $323,000.  A summary of the site work construction contract with McNabb Construction is listed below:
 
McNabb Construction            Original Contract:             $84,700.00
                              Change Orders:                $25,458.00
                              Total Contract Amount:        $110,158.00
 
There were two major change orders:  one added a concrete slab at the former restroom location for the relocation of picnic tables; and another installed a weather-based irrigation controller to conserve water and match controllers at other City parks.  
·      Public Works Services anticipates that the new restroom will reduce annual maintenance costs at the park in comparison to the former building
 
 
Budget Authority
 
·      The project was included in the Capital Improvement Program (CIP) in the 2007-2008 fiscal year, and a total amount of $300,000 was allocated  in CIP Account No. 210-62-008 for the project
·      An additional $24,758 in project funding for change order additions was provided from other accounts, including: $6,300 from account 010-62-001 authorized by the Public Works Department; and $18,458 from account 122-38-320 authorized by the Recreation and Human Services Department
