ADOPT:  Resolution Authorizing and Directing the City Manager to Sign and File, for and on Behalf of the City of San Leandro, a California Environmental Protection Agency (Cal/EPA) Grant Application to Implement Electronic Reporting Using the California Environmental Reporting System (CERS); and Authorizing and Directing the City Manager to Enter into and Sign, for and on Behalf of the City of San Leandro, an Agreement with Cal/EPA Agreeing to Implement Electronic Reporting with CERS (provides for $45,810 in grant)
 
Body
      WHEREAS, the City of San Leandro has been certified by the California Secretary for Environmental Protection as a Certified Unified Program Agency (the "San Leandro CUPA"); and
 
      WHEREAS, pursuant to Health and Safety Code, Chapter 6.11, section 25404(e)(1) & (2) and California Code of Regulations (CCR) Title 27, Division 1, Subdivision 4, Chapter 1, section 15185(a), CUPAs must collect and submit Unified Program information to the State; and
 
      WHEREAS, by January 1, 2013, all regulated businesses and Unified Program Agencies must submit Unified Program information electronically over the internet using a system called the California Environmental Reporting System ("CERS"); and
 
      WHEREAS, to assist the affected entities with the transition to electronic reporting via CERS, the California Environmental Protection Agency ("Cal/EPA") has established the CERS Grant Fund; and
 
      WHEREAS, the San Leandro CUPA desires to submit an application for a CERS Grant; and
 
      WHEREAS, in the event the San Leandro CUPA is awarded a CERS Grant from Cal/EPA, the City will be required to enter into a grant agreement which governs the disbursement and use of the grant funds; and
 
      WHEREAS, if the San Leandro CUPA is awarded a CERS Grant from Cal/EPA, the San Leandro CUPA shall use these grant funds in a manner consistent with the grant agreement, and any amendment thereto, to implement the requirements of the CERS electronic reporting system.
 
      NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
 
1.      The City Council authorizes the City Manager to submit a grant application to the California Environmental Protection Agency for a grant from the CERS Grant Fund.  
 
2.      The City Manager, or his designee, is hereby authorized and empowered to execute in the name of the City of San Leandro all necessary applications, contracts, agreements, and amendments thereto for the purposes of securing grant funds to implement and carry out the CERS electronic reporting mandate.
