RESOLUTION Calling a Special Municipal Election for Submission of a Question to the Qualified Voters Relating to a Charter Amendment to Provide That the Vice Mayor Designation be Made at the First Regular Meeting in January of each year; Consolidating the Special Municipal Election with the General Municipal Election to be Held Tuesday, November 4, 2014; Approving the Form of the Ballot Question; Setting Forth Procedures for Ballot Argument and Directing the City Clerk to Submit the Measure to the City Attorney for Impartial Analysis (adds to the November 2014 ballot a Charter amendment to change the month in which the Vice Mayor selection is made; cost to add the measure is approximately $7,000)
 
Body
      WHEREAS, under the provisions of the Charter, a General Municipal Election shall be held on November 4, 2014, for the election of Municipal Officers; and
 
      WHEREAS, the City Council also desires to call a Special Election to submit to the voters at the election a question relating to an amendment to the Charter of San Leandro to provide that the City Council designate one of its members Vice Mayor at the first regular meeting in January of each year, in closer proximity to the installation of new City Councilmembers.
 
      NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
 
      SECTION 1.  The City Council hereby calls a Special Municipal Election of the qualified voters of the City of San Leandro, to be held on November 4, 2014 to submit to the voters an amendment to the City Charter to provide for the City Council to designate one of its members Vice Mayor at the first regular meeting in January of each year (attached as Exhibit "A").
 
      SECTION 2.  The ballot measure shall appear and be printed upon the ballots to be used at the Election as follows:
 
Shall the City of San Leandro Charter be amended to provide that the City Council, at its first regular meeting in January of each year, shall designate one of its members Vice Mayor, to serve for a period of one year and until a successor is elected and qualified?
YES            NO
 
      SECTION 3.  Pursuant to the provisions of the Elections Code of the State of California, the City Council of the City of San Leandro hereby requests that the Special Municipal Election of the City of San Leandro to consider this measure be held November 4, 2014, in conjunction with and to be consolidated with the General Municipal Election for the City of San Leandro and the statewide election to be held in the City of San Leandro on said date, and further requests the Board of Supervisors of the County of Alameda to make its order of consolidation and thereafter call said consolidated election, and to direct the Alameda County Registrar to conduct all necessary services related to said election and to bill the City for the cost of conducting said election.
 
      SECTION 4.  That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law.
 
      FURTHER, the City Council of the City of San Leandro does hereby RESOLVE as follows:
 
      That written arguments for and against the ballot measure submitted to the voters of the City of San Leandro to be considered at the November 4, 2014 General Municipal Election will be permitted, not to exceed 300 words.  
 
      That the authors may prepare and submit rebuttal arguments not exceeding 250 words.  The rebuttal arguments shall be filed with the City Clerk not more than ten (10) days after the final date for filing direct arguments.
 
      That pursuant to Section 9280 of the California Elections Code this City Council hereby directs that the City Attorney prepare an impartial analysis of the measure to be placed before the electorate.
 
      That the City Clerk shall set the dates for filing of the arguments for and against the ballot measure.
 
      That no additional materials shall be authorized for submission to the City Clerk or shall be submitted by proponents or opponents of this measure to be mailed in addition to the Sample Ballot and Voters' Pamphlet.
 
      That in all other respects the provisions of Section 9280 through 9287 of the California Elections Code and other provisions of law pertaining thereto shall govern.
 
      SECTION 5.  That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
