SUMMARY AND RECOMMENDATIONS

 

Staff recommends that the City Council approve and authorize the City Manager to enter the City into a Project Funding Agreement with the Alameda County Transportation Commission (Alameda CTC). The agreement will grant Measure BB funds to the City for street rehabilitation.

 

BACKGROUND

 

On November 4, 2014, the voters of Alameda County, pursuant to the provisions of the Local Transportation Authority and Improvement Act, California Public Utilities Code Section 180000 et seq., approved Measure BB, thereby authorizing Alameda CTC to administer the proceeds from the extension of an existing one-half of one percent sales tax scheduled to terminate on March 31, 2022, and the augmentation of that tax by one-half of one percent.

 

The duration of the tax will be thirty years from the initial year of collection, which began on April 1, 2015, with the tax to terminate on March 31, 2045. The tax proceeds will be used to pay for the investments outlined in the 2014 Alameda County Transportation Expenditure Plan (“2014 TEP”), as it may be amended.  A portion of the annual proceeds is designated for discretionary funding of transportation projects within the County of which $30 Million has been programmed over five fiscal periods for the rehabilitation of San Leandro streets. 

 

As the City has been granted $3,000,000 in discretionary funds for the fiscal year 2016-17, a project agreement that sets forth the terms and conditions of the grant must be executed before the City is eligible to receive the funds.

 

Analysis

 

The terms and conditions of the grant are customary and the City can comply without hardship.  Alameda CTC will permit use of the City’s Local Inclusion Policy on the project; however, they have not yet determined if use of the City’s Community Workforce Agreement will be permitted.

 

Staff anticipates that the agreement will be amended each fiscal year to reflect additional grant funding up to the programmed total of $30,000,000.

 

The agreement attached to the resolution is substantially complete; however, minor changes to the language may occur.

 

Applicable General Plan Policies

 

Policy T 5.3: Maintenance. Regularly maintain City streets and traffic control devices to ensure that streets operate safely and efficiently. The City will strive for an overall Pavement Condition Index of 76, which is the lower limit of industry best practices.

 

Legal Analysis

 

The City Attorney’s Office reviewed the agreement, and it is approved as to form.

 

Fiscal Impacts

Execution of the agreement will provide funds for rehabilitation of City streets.
