Resolution of the Successor Agency to the Redevelopment Agency of the City of San Leandro Authorizing the Acceptance of Quitclaim Deeds for Properties Previously Transferred by the Former Redevelopment Agency of the City of San Leandro to the City of San Leandro

WHEREAS, the Redevelopment Agency of the City of San Leandro (the "Agency") previously approved an action transferring certain real assets pursuant to disposition and development agreements and assignment agreements from the City of San Leandro (the "City") on March 3, 2011 by Agency Resolution No. 2011-004 RDA and City Council Resolution No. 2011-058; and
WHEREAS, on June 28, 2011, the California Legislature adopted, the Governor signed, and in December 29, 2011 the California Supreme Court in California Redevelopment Association, et al. v. Ana Matosantos, et al., upheld ABx1 26 ("AB 26"), legislation that amends the California Redevelopment Law and provided that the Redevelopment Agency be dissolved effective as of February 1, 2012; and
WHEREAS, under AB 26, the Redevelopment Agency was replaced with the Successor Agency to the Redevelopment Agency of the City of San Leandro (the "Successor Agency") effective February 1, 2012; and
WHEREAS, among other things, AB 26 voids certain transactions between the Redevelopment Agency and the City that occurred after January 1, 2011; and
WHEREAS, the City now desires to transfer the following assets (collectively, the "Assets") from the City back to the Successor Agency:

NOW, THEREFORE, BE IT RESOLVED by the Governing Board of the Successor Agency to the Redevelopment Agency of the City of San Leandro that it does hereby resolve as follows:
1. Finds that the above recitals are true.
2. Approves the transfer of the Assets listed above by quitclaim deed.
3. Authorizes the Executive Director to execute and deliver such instruments and to take such actions as necessary to carry out the intent of this Resolution.
