SUMMARY

 

The second amendment to the Consulting Services Agreement with Larry Walker Associates, Inc. (LWA) will enable the City to continue planning for urgent stormwater compliance-related program development, implementation, and reporting.

 

RECOMMENDATIONS

 

Staff recommend that the City Council approve and authorize the City Manager to execute a second amendment to the Consulting Services Agreement with LWA for Municipal Regional Stormwater Permit (MRP) compliance support, increasing the contract amount by $160,800 for a new total not-to-exceed amount of $380,300. The proposed amendment will fund LWA’s ongoing services through the next fiscal year ending on June 30, 2027. 

 

BACKGROUND

 

As a result of the 1972 Clean Water Act that established the National Pollutant Discharge Elimination System (NPDES), the San Francisco Regional Water Quality Control Board (RWQCB) issues the Municipal Regional Stormwater Permit (MRP), which specifies and mandates stormwater pollution prevention activities. The MRP requires 70+ municipalities in the Bay Area, including the City of San Leandro, to place conditions on development projects to incorporate site design measures, source controls, treatment measures, and on larger projects, flow duration controls (FDCs), and requires the City to inspect, maintain, and install trash control programs and infrastructure. 

 

On September 1, 2024, the City entered into an agreement with LWA for MRP compliance planning support, and as of FY 2025, the City has utilized the existing contract’s not-to-exceed amount of $49,000.

 

On August 25, 2025, the City amended the agreement with LWA for MRP compliance planning support, including assistance with additional compliance tasks as required by RWQCB, and as of the end of FY 2026, the City will use the existing contract’s not-to-exceed amount of $219,500.

 

For FY 2027, additional work will be needed to implement new programs that were developed toward the City’s required goal of 100% Trash Load Reduction compliance, and to maintain existing programming and annual reporting that will cost an additional $160,800.

 

 

Analysis

 

The provisions of the MRP are complex and increasingly progressive with each update to the permit. The current permit is MRP 3. The provisions of the permit are technical and expensive to implement, and LWA assistance will allow for clearer navigation of these requirements.

 

LWA will assist Staff in the planning and implementation of the requirements the current MRP, including support for the development of the MRP Annual Report.

 

Previous Actions

 

On July 21, 2026, by Resolution No. 2025-105, the City Council approved Amendment No. 1 to a Consulting Services Agreement with Larry Walker Associates Inc. for Municipal Regional Stormwater Permit (MRP) Compliance Planning Support.

Legal Analysis

 

The consultant has agreed to the terms of the contract.

 

Financial Impacts

 

The first amendment to the Agreement with LWA increased the total not-to-exceed amount to $219,500 and was executed August 25, 2025.

 

Sufficient funds are included in the FY 2027 Storm Water Fund adopted budget for consulting services in addition to remaining consulting services balance from FY 2026 that will be carried forward into the FY 2027 Storm Water Fund budget, which will fund Amendment No. 2 in the amount of $160,800.

 

The amended Agreement will not impact fund balance because there are funds available in FY 2026 and FY 2027 adopted budgets.
