SUMMARY

The second amendment to the Consulting Services Agreement with HF&H Consulting, LLC ("HF&H") will enable the City to continue recycling program support services, and additional SB 1383 compliance related program development, implementation, and reporting.

RECOMMENDATIONS

Staff recommend that the City Council approve and authorize the City Manager to execute a second amendment to the Consulting Services Agreement with HF&H for additional SB 1383 compliance activities, franchise tracking, recycling program development and reporting support for a not-to-exceed amount of $201,980. The proposed amendment will fund HF&H's ongoing services through June 30, 2026.

BACKGROUND

Senate Bill (SB) 1383, officially known as the Short-Lived Climate Pollutant Reduction Strategy (2016) set targets for 2025: 75% less organic waste sent to landfills below 2014 levels, and required 20% of unsold, still-edible food to be sent to food recovery organizations. Implementing this law required myriad and complex changes to existing solid waste franchise systems, required procurement recovered organic material, and a host of reporting challenges for local jurisdictions.

On September 5, 2023, the City entered into an agreement with HF&H, and as of the end of last fiscal year (the fiscal year ending June 30, 2025), the City has utilized all but $7,634.50 of the existing contract's not-to-exceed amount of $80,000. Additional work was identified to continue recycling program services support and additional SB 1383 support that will cost an additional $121,980.
