RESOLUTION Establishing Application Fees for the Medical Cannabis Dispensary Program (establishes fees to off-set the City's anticipated staffing, operational and consulting costs associated with implementing a three-round application process)

WHEREAS, in December 2013, the City Council approved a medical cannabis regulatory ordinance to facilitate the approval, regulation, and operation of one medical cannabis dispensary in the City of San Leandro; and
WHEREAS, that ordinance states that applicants seeking to operate the one dispensary shall pay a non-refundable application fee as well as any other costs associated with reviewing their background; and
WHEREAS, the City Manager and City staff have analyzed the anticipated staffing, operational, and consulting costs that will be necessary to develop and implement the process that will lead to a recommendation to the City Council regarding who that operator should be; and
NOW, THEREFORE, BE IT RESOLVED that the fees established shall:
· Not exceed $1,000 for the Round 1 background screening of each of the key members of the applicant operator team;
· Not exceed $3,000 for the Round 2 dispensary application; and
· Not exceed $9,000 for the Round 3 review of any finalists who advance through Rounds 1 and 2.
