SUMMARY

Amends an existing consulting services agreement to add scope and fee related to changes in schedule and duration of the bridge removal work.

RECOMMENDATIONS

Staff recommends approval of Amendment 2 to the agreement with Terraphase Engineering, Inc.

BACKGROUND

A pedestrian bridge over San Leandro Creek that connects Cary Drive with Haas Ave was severely bent and knocked off the abutments during a windstorm in March, 2023 when two trees fell onto it. The City subsequently hired Terraphase Engineering, Inc to provide biological studies required for work permits and also to apply for and coordinate permitting with the agencies that regulate work in the creek. An amendment to the agreement with Terraphase added monitoring of the work during construction as required by the permits and to ensure habitat, plants, and animals are protected.

The City hired McGuire and Hester, a contractor based in Oakland, to remove the bridge. Permits for the work were obtained in December, 2023 contingent upon both dry weather and an accelerated construction schedule that required the contractor to work overtime and 7 days a week. In anticipation of the work, Terraphase performed pre- construction animal surveys. Unfortunately, the winter of 2023-2024 contained no suitable period of dry weather, the work was not completed, and the work is now scheduled to start at the end of July, 2024. The work will occur during the dry season so the contractor does not need to accelerate the work and overtime is not anticipated.
