Discussion to Consider Implementation of Restorative Justice Mediation Into the City Council Discipline Policy

SUMMARY
Consistent with direction at the April 6, 2026 City Council meeting, this agenda item is scheduled to hold a discussion to consider restorative justice mediation for the City Council.
RECOMMENDATION
Staff recommend the City Council Rules Committee discuss the item and provide further direction to Staff.
BACKGROUND
On January 5, 2026, the City Council considered an item regarding the public release of an independent investigation report prepared in response to a complaint submitted by Councilmember Xouhoa Bowen to the Human Resources Department. As part of its action, the City Council directed that a future agenda item be scheduled to discuss the potential use of restorative justice mediation for the Council.
The item was subsequently heard on April 6, 2026. Following discussion, the City Council referred the matter to the City Council Rules Committee for consideration of how restorative justice mediation could be incorporated into the City Council Internal Discipline Policy, which is set forth in Title A1, Chapter 13 of the Administrative Code.
On April 22, 2026, the City Council Rules Committee considered the item. After discussion, the Committee agreed to continue the matter to a subsequent Rules Committee meeting to allow time for the Committee to research and further define restorative justice mediation and what proposed incorporation into the City Council Internal Discipline Policy would look like. Councilmember Fred Simon submitted proposed amendments to the City Council Internal Discipline Policy (Attachment B) for the Committee's consideration and discussion.
