RESOLUTION No. 2020-003 of the Board of Zoning Adjustments of the City of San Leandro, approving a Conditional Use Permit for PLN19-0060 at 2994 Teagarden Street.

Body

WHEREAS, Fantasy Elixirs and Medicinals ("Applicant") submitted an application for Conditional Use for a proposed ?935 square foot Cannabis Product Manufacturing facility within an existing industrial building at 2994 Teagarden Street, zoned IG (Industrial General). (PLN19-0060) ("Project"); and

WHEREAS, 2994 Teagarden St. ("Property"), the subject site, consists of a ?4,495 square foot tenant space shared with House Kombucha within a 4-building cluster accommodating approximately 23 total tenants. The ?4,495 square foot unit is in the southeast corner of building #3; and

WHEREAS, the Property is zoned (IG) Industrial General and has a General Plan designation of Light Industrial area (IL); and

WHEREAS, a Conditional Use Permit is required to establish a ?935 square foot Cannabis Product Manufacturing facility for cannabis infused kombucha and beverages within an existing ?4,495 square foot structure at 2994 Teagarden Street. Per San Leandro Zoning Code Section 2-706.B.14, the applicant is required to secure approval of a Conditional Use Permit prior to establishment of a Cannabis Product Manufacturing facility in the IG Industrial General District; and

WHEREAS, the Project is categorically exempt from the California Environmental Quality Act (CEQA) per CEQA Guidelines, Article 19, Section 15301 for Existing Facilities that involves minor alterations and negligible expansion of use; and

WHEREAS, the Board of Zoning Adjustments held a duly noticed public hearing regarding the proposed Project on February 6, 2020, at which time all interested parties had the opportunity to be heard; and
