ADOPT: Resolution Amending Section 6.4.100 of the San Leandro Administrative Code to Increase the Subpoena Fee for the Personal Appearance of Police Officers (increases the witness fee for a police officer from $150 to $275 to conform with a change to state law)

WHEREAS, California Government Code Section 68097.2 provides for a witness fee to be charged at the time a subpoena is served for the attendance of certain public employees, including peace officers and firefighters.
WHEREAS, Assembly Bill 2612 amended California Government Code Section 68097.2(b) to increase the witness fee of police officers from $150 to $275.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That following notice and hearing as may be required by law, Title 6, Chapter 4, Section 6.4.100 of the San Leandro Administrative Code ("Fee Schedule") is hereby amended to add a separate fee for personal appearance of police officers (shown in bold and italics), as follows:
CITYWIDE
3. Subpoena Fees
A. Records $15.00
B. Personal appearance of City employees $150.00
C. Personal appearance of police officers $275.00
2. That the provisions of the Fee Schedule as amended shall take effect immediately.
