RESOLUTION Consenting to the Proposed Location of 1-Marquee Sign at the Burrell Sports Field Related to Caltrans Outdoor Advertising (ODA) Permit Application Nos. A04-0566 and A04-0567

WHEREAS, in 2014 the City of San Leandro (City) and the San Leandro Unified School District ("SLUSD" or the "District") executed a joint use agreement for Burrell Sports Field and the Pacific Sports Complex; and
WHEREAS, the City and the District would like to see a marquee state of the art electronic sign erected upon District property adjacent to the Burrell Sports Field to promote District events, community events, and City economic development; and
WHEREAS, in coordination with the SLUSD, American Outdoor Advertising submitted Outdoor Advertising Act permits to the California Department of Transportation (CalTRANS) for the construction of 1-Marquee sign at the Burrell Sports Field; and
WHEREAS, on October 15, 2015, the District received approval from the California Department of General Services, Division of the State Architect on its plans and specifications to construct 1-Marquee Sign for the Burrell Sports Field (Increment # 0, Application #01-113962, File #1-35, a copy of which is attached and made a part hereof); and
WHEREAS, California Education Code section 17280 provides that the Department of General Services, by and through the Division of the State Architect (DSA), has exclusive jurisdiction over all aspects of public school construction to ensure that plans, specifications and construction comply with the building codes applicable to school buildings. The Burrell Sports Field is used for public school programs, and thus qualifies as a public school facility subject to the jurisdiction of the DSA; and
WHEREAS, California Business & Professions Code section 5354(a) provides that the city with land use jurisdiction over the property upon which the location for the CalTR...
