RESOLUTION Authorizing the City Manager to Enter into a Legal Services Agreement with Bertrand, Fox and Elliot for Legal Defense Services Relating to General Liability Tort Claims Litigation (approves agreement for an amount not to exceed $100,000 from the Self Insurance Fund)

WHEREAS, the City in accordance with its purchasing provisions has identified Bertrand, Fox and Elliot to provide legal defense services relating to general liability claims litigation; and
WHEREAS, the City wishes to enter into an agreement with Bertrand, Fox and Elliot for said work; and
WHEREAS, the City Council is familiar with the terms of the agreement; and
WHEREAS, the City Manager recommends approval of said agreement.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the agreement with Bertrand, Fox and Elliot in an amount not to exceed $100,000 is hereby approved, and $100,000 appropriation from the Self Insurance Fund account 689-19-004 is also approved; and
2. That the terms of the agreement will be memorialized in writing by the City Manager, subject to the approval of the City Attorney; and
3. That the City Manager is authorized to execute said agreement; and
4. That an original executed agreement shall be provided to the City Clerk and shall be attached to and made a part of this resolution.
