ADOPT: Ordinance No. 2012-006, an Ordinance Amending Title 1, Chapter 6 of the San Leandro Municipal Code Relating to Purchasing (updates the purchasing authority of the City Manager in an emergency and of the City Council without competitive bidding)

The City Council of the City of San Leandro does ORDAIN as follows:

SECTION 1. PURPOSE. The purpose of this Amendment is to increase the City Manager’s purchasing authority in an emergency without competitive bidding and without Council approval to $50,000, and to add “services” to those commodities the City Council may approve purchases of without competitive bidding.

SECTION 2. AMENDMENT OF CODE. Title 1, Chapter 6 of the San Leandro Municipal Code is hereby amended as follows:

1-6-310 EMERGENCIES.

Purchases of equipment, materials, supplies and services determined by the City Manager or his or her designee to be necessary to respond to an emergency which threatens the public health, safety or welfare may be made without competitive bidding and without Council approval if such purchases are in the amount of Fifty Thousand Dollars ($50,000) or under.

1-6-315 COUNCIL DETERMINATION.

Purchases of equipment, materials, services and supplies determined by the Council to serve the best interests of the City may be made without competitive bidding.

SECTION 3. SEVERABILITY. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this Ordinance, or its application to any other person or circumstance.
