Title
Resolution Authorizing the City Manager to Negotiate the Purchase of a Portion of 501 143rd Avenue to Widen the Public Right-of-Way at the Corner of 143rd and Washington Avenues to Allow for the Relocation of a Signal Controller Box

Body
WHEREAS, it has come to the City's attention that it is necessary to relocate a signal controller box at the intersection of 143rd and Washington Avenues because of repeated instances of trucks hitting and disabling the controller box while turning from 143rd Avenue to Washington Avenue; and

WHEREAS, City engineering staff analyzed all viable options and determined that the most efficient approach will be to relocate the signal controller box back behind the sidewalk area, which will require the acquisition of 67.5 sq. ft. in fee and 155.67 sq. ft. for a temporary construction easement at the property owned by Public Storage; and

WHEREAS, under California Government Code section 65402, and San Leandro Administrative Code section 5.7.105, the acquisition of this property is exempt from a General Plan Conformance finding by the Planning Commission; and

WHEREAS, the City Manager recommends this action to preserve the City's streets and traffic control devices.

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

1.      That the City Manager or her designee is authorized to negotiate the acquisition of the property referred to above; and

2.      That the City Manager is authorized to execute any and all agreements to acquire the property referred to above, subject to the approval of the City Attorney.
