Resolution Authorizing the City Manager to enter into Service Contract No. 75LX204 with the State of California, Department of Transportation, for funds from the At-Grade Highway Rail Crossing Program for the Hesperian Boulevard at Springlake Drive Railroad Crossing

WHEREAS, this Service Contract is for the elimination of hazards at Railroad-Highway intersections (crossings); and

WHEREAS, the project is located in the City of San Leandro (City), at the grade crossing located at the intersection of Hesperian Boulevard and the Union Pacific Railroad tracks, CPUC No. 001D17.50, Federal DOT No. 749745L; and

WHEREAS, funding for this Service Contract is provided to the State of California, Department of Transportation (Department) under Section 130, Title 23 USC; and

WHEREAS, said elimination of hazards is a cooperative effort between the Department, the City, the California Public Utilities Commission (CPUC) and Union Pacific Railroad (Railroad); and

WHEREAS, the CPUC has evaluated the crossing and determined what improvements are necessary; the Department acts as a conduit for the federal funds to the City and Railroad and the City are responsible for building and maintaining the improvements mandated by the CPUC; and

WHEREAS, that an agreement between the City and Department, a copy of which is attached, has been presented to this Council; and

WHEREAS, the Council is familiar with the contents of the Service Contract; and

WHEREAS, the City Manager has recommended approval of said Service Contract.

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

That the City hereby agrees to do the work as described in the Service Contract for the Department in accordance with all applicable laws including but not limited to, California Streets and Highway Code section 114(b) and California Government Code 14038 and regulations and the provision of the Service Contract and attached exhibits; and
