ORDINANCE Adding Chapter 4-33 to Title 4 of the San Leandro Municipal Code Pertaining to Medical Cannabis Dispensary Permits (provides for establishment of up to two medical marijuana dispensaries in the City and regulates their operations)

The City of San Leandro City Council does hereby ORDAIN as follows:
SECTION 1. AMENDMENT OF CODE. San Leandro Municipal Code Title 4 is hereby amended to add Chapter 4-33, as set forth in Attachment incorporated into this ordinance by this reference.
SECTION 2. SEVERABILITY. This Chapter shall be enforced to the full extent of the authority of the City. If any section, subsection, paragraph, sentence or word of this chapter is deemed to be invalid or beyond the authority of the City, either on its face or as applied, the invalidity of such provision shall not affect the other sections, subsections, paragraphs, sentences, or words of this chapter, and the applications thereof; and to that end the sections, subsections, paragraphs, sentences and words of this chapter shall be deemed severable.
SECTION 3. EFFECTIVE DATE AND PUBLICATION. This ordinance shall take effect upon the certification of a City ballot measure that approves the taxation of the gross receipts generated by the operations of any Dispensary operating within the City thirty (30) days after adoption. The City Clerk is directed to publish the title once and post a complete copy thereof on the City Council Chamber bulletin board for five (5) days prior to adoption.
