SUMMARY AND RECOMMENDATIONS
 
Staff recommends that the City Council adopt a resolution amending the City's Fee Schedule to increase the subpoena fee for the personal appearance of City employees from $150 to $275 to conform with a change to state law.
 
BACKGROUND
 
Assembly Bill 2727, effective January 1, 2015, amended California Government Code Section 68096.1 to increase the witness fee for local agency employees, from $150 to $275 for each day that the employee is required to be in attendance at the proceeding pursuant to the subpoena.  Because the fee is listed in the City's Fee Schedule, the Fee Schedule must be amended to reflect the increase.
 
Current Agency Policies
 
The City's Fee Schedule is codified in Title 6, Chapter 4 of the San Leandro Administrative Code.
 
Previous Actions
 
In 2013, pursuant to the passage of AB 2612, the City Council approved an amendment to the Fee Schedule to increase the subpoena fee for the personal appearance of police officers from $150 to $275 to conform with the change to state law.
 
Fiscal Impacts
 
The increased subpoena fee will result in a small increase to the General Fund revenue.
