RESOLUTION Amending Section 6.4.100 of the San Leandro Administrative Code to Increase the Subpoena Fee for Personal Appearance of City Employees from $150 to $275 to Conform with a Change to State Law

WHEREAS, California Government Code Section 68096.1 requires the party subpoenaing a local agency employee to tender a fee with the subpoena to the local agency; and
WHEREAS, Assembly Bill 2727 amended California Government Code Section 68096.1 to increase the subpoena fee of local agency employees from $150 to $275 for each day that the employee is required to be in attendance at the proceeding pursuant to the subpoena.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That Title 6, Chapter 4, Section 6.4.100 of the San Leandro Administrative Code ("Fee Schedule") is hereby amended to increase the subpoena fee for personal appearance of City employees, as follows (shown in bold and italics):
CITYWIDE
3. Subpoena Fees
A. Records $15.00
B. Personal appearance of City Employees $150.00 $275.00
C. Personal appearance of Police Officers $275.00
2. That the provisions of the Fee Schedule as amended shall take effect immediately.
