RESOLUTION to Increase Change Order Cap from 25% to 40%, Which Would Result in an Additional Increase of $28,658.00 for a Total Increase to the Original Agreement of $52,319.00 for a Total not to Exceed Amount of $183,118.00 in the Agreement and Authorizing the City Manager to Execute Amendment No. 1 with Carollo Engineers, Inc., for the Water Pollution Control Plant (WPCP) Dirt Relocation Project, Project No. 2015.0300.

WHEREAS, the City of San Leandro did, on March 17, 2014, approve a Consulting Services Agreement with Carollo Engineers, Inc. for the Water Pollution Control Plant Dirt Relocation project; and
WHEREAS, the cost to complete change order services will exceed the project's Change Order cap; and
WHEREAS, the project budget is sufficient to accommodate the increased Change Order cost; and
WHEREAS, draft Amendment No. 1 between the City of San Leandro and Carollo Engineer, Inc. has been presented to this City Council and
WHEREAS, the City Council is familiar with the contents thereof; and
WHEREAS, the City Manager has recommended approval of said Amendment No. 1.
NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:
1. That the Change Order Cap is increased to 40%, or $52,319.00, such that the total not to exceed amount of the Agreement is increased to $183,118.00 for the Carollo Engineers, Inc. Agreement on the WPCP Dirt Relocation Project, Project No. 2015.0300, and approval is granted for the attached amendment reflecting the not to exceed amount.
2. That said Amendment No. 1 substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and
3. That the City Manager is authorized to make non-substantial revisions to said Amendment, subject to the approval of the City Attorney; and
