RECOMMENDATIONS
Staff recommends that the City Council approve the finding of the independent hearing officer, which is that the business licensees, Mr. Kenny Ma and Ms. Run He, failed to show cause why the action or determination of the Finance Director should not be approved. Based upon the evidence submitted and the findings of the Hearing Officer, the business license revocation for the Green Leaf Spa should be upheld and the appeal should be denied
BACKGROUND AND SUMMARY
Pursuant to City of San Leandro Municipal Code section 2-2-450, on July 20, 2015, by a resolution with a Legistar File ID of 15-449, the City Council referred the appeal of the business license revocation of the Green Leaf Spa's owners, Mr. Kenny Ma and Ms. Run He, to a Hearing Officer. The City Council, based upon the record only, may approve or disapprove the Hearing Officer's Findings. On September 14, 2015, Valerie Armento, the City's independent Hearing Officer for this case, held a hearing for the licensee to show cause why the action or determination of the Finance Director should not be approved. On September 18, 2015, the Hearing Officer rendered her findings, and decision. The Hearing Officer's findings and decision are attached to the resolution related to this recommended action.
Pursuant to the Hearing Officer's Findings and Decision, the licensees failed to show cause why the action or determination of the Finance Director should not be approved, which was to revoke the business license. Based upon the evidence submitted and the findings, the business license revocation of the Green Leaf Spa should be upheld and the Green Leaf Spa's Owners' appeal of the business license revocation should be denied.
