Title

RESOLUTION Authorizing the City Manager to Execute a Consulting Services Agreement with Athen B. Gallery for the Curation, Installation, and Maintenance of Mural Art in Four San Leandro Locations

 

Body

WHEREAS, an agreement between the City of San Leandro and Athen B. Gallery, a copy of which is attached, is presented to this City Council; and

 

WHEREAS, the City Council is familiar with the contents thereof;

 

WHEREAS, amendments to the agreement to clarify the work or respond to atypical existing conditions are a normal aspect of public contracting and procurement of services; and

 

WHEREAS, in order to expedite the delivery of public projects on schedule and on budget, provide that the subcontractors and workers are paid in a timely fashion, avoid as much as possible costly delay claims, and ensure that the City completes projects according to the City’s highest standards, the City Council finds that providing authorization to negotiate and approve amendments to the consulting services agreement is in the best interest of public welfare; and

 

WHEREAS, the City Manager recommends approval of said agreement.

 

NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

 

That said agreement is hereby approved and execution by the City Manager

is hereby authorized; and

 

That the City Manager or his designee is hereby authorized to negotiate and approve cumulative amendments to the agreement up to a maximum of 25% of the original contract amount, or $20,000.
